MEMORANDUM <br />To:Saint Anthony Village Planning Commission <br />From:Stephen Grittman, City Planner <br />Date:September 16, 2025 <br />GC Project No.140.01 – 25.04 <br />Property Location:3901 Foss Road, Suite D; PID: 31-30-23-41-0008 <br />Request: Conditional Use Permit for Catering in L-I, Light Industrial District <br />BACKGROUND <br />The applicants are a coffee service catering provider seeking approval to relocate to an industrial <br />building at 3901 Foss Road. The applicants would occupy a portion of the existing building, <br />approximately 1,400 square feet. The total building square footing is approximately 12,000 square feet. <br />GENERAL INFORMATION <br />Catering operations are allowed in the L-I district by Conditional Use Permit. The purpose of the <br />Conditional Use Permit requirement for food-service related businesses is common to review sanitary <br />sewer and water needs, for which food operations can be prodigious users. In this case, the coffee <br />business is less likely to raise these issues, but additional review from public works will regulate this <br />aspect of the business use. From a land use standpoint, there would not appear to be any significant <br />impacts on the surrounding area. <br />ANALYSIS <br />The zoning ordinance lists the following required findings for consideration of a Conditional Use Permit: <br />(C) City Council action. A conditional use permit may be granted only by a majority vote of all <br />members of the City Council after determining that: <br />(1) The use is one of the conditional uses specifically listed for the district in which the <br />property is located; <br />(2) The City Council has specified all conditions which the City Council deems <br />necessary to make the use compatible with other uses in the area. <br />(3) The use will not be detrimental to the health, safety, or general welfare of persons <br />residing or working in the vicinity or to the values of property in the vicinity; and <br />(4) The use will provide a service or a facility which is in the interest of public <br />convenience and will contribute to the general welfare. <br />The use is specifically listed in the district, and the site has been developed for industrial uses. As noted <br />by the applicants, only limited employee counts are likely, with a total of 10 employees, and no more <br />than 3 employees on site at most times.
