MEMORANDUM <br />To:Saint Anthony Village City Council <br />From:Charlie Yunker, City Manager <br />Date:December 9, 2025 <br />Request: Approval of Resolution 25-084 – Approval of Environmental Response Fund <br />Grant and Subgrant Agreement for the Tibyan Community Center <br />BACKGROUND <br />At the City Council meeting on October 22, 2024 the City Council approved an amendment to the <br />Planned Unit Development (PUD) zoning district for changes to the uses and development plans <br />in the Kenzie Terrace PUD Overlay District. One of the conditions of approval was to fulfill any <br />requirements of the Minnesota Pollution Control Agency (MPCA) Response Action Plan for the site. <br />Subsequently, the applicant applied for financial assistance from the Environmental Response Fund to <br />help fulfill those requirements. The application was made in the name of the City of Saint Anthony <br />Village to strengthen the application, and $136,250 was awarded. The associated Grant Agreement <br />reflects that award is made between the City and Hennepin County. They City’s role in this grant is <br />limited to acting as a ”pass-through” for the grant funds only. <br />The City Attorney has reviewed the Grant Agreement and did not identify any concerns, and added a <br />recommended Subgrant Agreement to be put in place. This is so the obligations under the Grant <br />Agreement contractually rest with the Tibyan Community Center, and not the City, should any <br />obligations not be met. The City Attorney drafted the Subgrant Agreement and all parties are in <br />agreement with the Subgrant Agreement. <br />Approval of these agreements allows the grant funds to be utilized by the Tibyan Community Center to <br />fulfill the requirements of the Minnesota Pollution Control Agency (MPCA) Response Action Plan as per <br />the conditions included with the City Council’s Resolution 24-063 approved October 22, 2024. <br />RECOMMENDATION <br />Staff recommends approval of Resolution 25-084, the Grant Agreement and Subgrant Agreement. <br />ATTACHMENTS <br />Environmental Response Fund Grant <br />Subgrant Agreement <br />Resolution 25-084 <br />35
