April 14, 2026 Saint Anthony Council Work Session - 3 <br />Councilmember Elnagdy stated that they can require owner-occupancy in the original structure. City <br />Planner Grittman confirmed this and stated that there can be size requirements on the ADUs. <br />Mayor Webster explained that there is a certain number of allowable rental units in each zone. If a <br />homeowner wanted to build an ADU for rental, it would have to fit into the allowed number. <br />Councilmember Doolan asked if the units would count towards the limited rental slots if they are owner- <br />occupied. <br />Councilmember Jenson asked what happens when the current owner moves. <br />Councilmember Elnagdy followed up on Councilmember Doolan's previous comment about the rental <br />slots and stated that she was unsure whether there was that much room for nuance in the language. <br />Councilmember Elnagdy asked if they would like to allow for only above-building ADUs. She also asked <br />whether ADUs would count as rentals if the additional tenants were not paying rent. City Planner <br />Grittman stated ADUs would count as rentals if they had a rental license. Councilmember Elnagdy asked <br />if a homeowner would need a rental license to build an ADU. Mr. Grittman stated that homeowners <br />would if you were planning to treat it as a separate unit. He clarified that if the new space has a kitchen, <br />bathroom, sleeping quarters, a separate entrance, and no interior access to the current unit, you would <br />be creating a duplex. <br />Councilmember Doolan asked what would happen if someone wanted to tear down an existing <br />structure and build two new units, one to occupy and one to rent. She also highlighted privacy concerns <br />for neighbors when building upwards and asked whether placement on the lot would matter for ADUs. <br />Councilmember Jenson asked if Council would have to modify the number of rental units allowed to <br />accommodate allowing ADUs. City Planner Grittman stated that the Council would have to decide <br />whether ADUs would be included in the overall rental cap or be exempted from it. <br />Mayor Webster expressed her appreciation that ADUs will introduce gentle density, which they are <br />looking to achieve in single-family-zoned neighborhoods. She also pointed out concerns for current <br />families about aging baby boomers. Care facilities are expensive, and many families may prefer to invest <br />the money to build a new home on their property to care for aging loved ones. Councilmember Doolan <br />also noted that caregivers could live in the additional units. <br />Councilmember Jenson asked whether the Council would like to request a draft ordinance. <br />Councilmember Doolan stated that a community conversation would be beneficial. She cited New <br />Brighton’s ordinance, which relied on community surveys. Councilmember Doolan stated it would be <br />important to determine how many properties are even capable of adding a second unit, given the <br />impervious surface requirements, or whether most of the opportunity would be to build above existing <br />units. Councilmember Doolan asked whether adjusting ordinances to allow ADUs could be part of the <br />next Comprehensive Plan. <br />Councilmember Jenson appreciated the idea of getting community input. Mayor Webster also expressed <br />interest in obtaining community input and generating education around ADUs. <br />5
