Included in this section is a note that applicants may seek relief by applying for a variance. Since the <br />Sustainable Building Ordinance is a component of the zoning ordinance, the terms of the zoning <br />variance process would apply to this section. <br />The third aspect of the proposed ordinance sets a series of standards that would apply to the buildings <br />identified in the second section. These include a reduction in energy use, a reduction in water use, <br />modifications to incorporate renewable energy sources, compliance with the City’s EV charging <br />requirements, a plan for diversion of construction waste from landfills and incinerators, and <br />improvements that will reduce stormwater runoff from the site. <br />Finally, the fourth section establishes a compliance and monitoring protocol through a third party <br />evaluator. This draft suggests that evaluation would occur at both permit application and one-year <br />stages to measure the impacts of both building compliance and ordinance effectiveness. Other methods <br />may be appropriate in this regard. <br />RECOMMENDATION/COUNCIL ACTION <br />Staff asks the Council to review the draft ordinance to ensure that the proposed ordinance reflects the <br />Council’s priorities. The PEC recommended this draft, modified in a few places to add clarity and ensure <br />consistency with the City’s Climate Plan objectives. <br />NEXT STEPS <br />Subject to Council comment and direction, this draft ordinance would next be reviewed by Planning <br />Commission which would hold a formal public hearing.
