ORDINANCE NO. ___ <br />owner’s homestead. In the event an owner of property with an ADU <br />sells to a new buyer who wishes to continue the ADU rental and <br />tenant, the seller and buyer may request that the City transfers the <br />ADU license to the new owner upon sale. <br />(c)No parcel may contain more than one ADU per single family detached <br />dwelling. <br />(d)Any ADU occupied by a renter shall require a rental license, for which <br />the City shall record as a second class of single family rental licenses. <br />ADUs occupied by a relative of the owner will require an ADU <br />license, notwithstanding the exemption to rental licensing for qualified <br />relatives. <br />(e)An ADU shall not be included in the eligible number of single family <br />dwelling rental licenses in the City’s maximum rental license caps, <br />either for total or neighborhood-level totals. <br />(f)Short-term rentals shall not be allowed to occupy ADUs. <br />(3)Operational Requirements. <br />(a)Structure Requirement. Any ADU shall be required to be part of, or <br />attached to, an existing principal dwelling or a detached structure. No <br />freestanding ADUs, nor any attachment to or occupancy of any other <br />accessory building shall be allowed. <br />(b)Utility Connections. An ADU shall be connected to City sanitary <br />sewer and water supplies through a connection to the principal <br />dwelling. No separate connections to City sewer or water mains shall <br />be permitted. <br />(c)Public Service Capacity. The City reserves the right to cap ADU <br />licensing in the event public services (streets, sanitary sewer, water, <br />parks, or others) in any area of the City approach the City’s service <br />capacities. <br />(d)Parking. Any licensed ADU must demonstrate compliance with the <br />City’s existing off-street parking requirements for the principal <br />dwelling (2 spaces, at least one of which must be enclosed), plus one <br />additional off-street parking space for the ADU. <br />(e)Floor Area. ADUs shall contain no less than 400 square feet of <br />habitable space, and a maximum of 600 square feet. Occupancies <br />shall be limited to no more than 2 adult occupants of 19 years of age or <br />greater, along with dependent minor children less than 19 years of age. <br />All building codes shall apply to the ADU. In this regard, total <br />occupancy may be no greater than one person for the first 150 square <br />feet, one person per each additional 100 square feet. <br />(f)Accessibility and Egress.
