Lindgren <br />DATE: November 3, 2004 <br />RE: Vacation of Portion of Apache Lane <br />At its meeting on November 9"i the City Council will be holding a public hearing on the <br />vacation of a portion of Apache Lane. As part of the for sale and rental housing development <br />occurring in connection with the redevelopment of Apache Plaza, a portion of Apache Lane will <br />no longer be required for public access under the re -platted property. The Redevelopment <br />Agreement, dated December 19, 2003, provides that the City will consider the Developer's <br />application, in accordance with state law and City ordinances, in a time frame consistent with <br />development of the first housing phase. <br />We have prepared a resolution vacating a portion of the public right -of way and <br />recommend that the City Council adopt this resolution. <br />CORS -1y & W'HITNEY LLP, <br />4826-2534-9888\1 11/3/2004 1:48 PM <br />
