STAFF REPORT 36
To: Planning Commission// Report No.: V11.1.
From: Kira Moore -Sykes, Assistant City Manager ld
Date: April 19, 2005
Subject: Conditional Use Permit Request for 3605 - 29u' Avenue NE
Ite_c uested lection:.
Patrick O'Com-Lor, the applicant, is requesting that he be granted a Conditional Use Permit for a. proposed
auto dealership .for specialized, classics and custom cars that he wants to locate at 3605 - 29th Avenue NE.
This property is located in the Light Industrial Zoning District.
Background:
Mr. Patrick O'Connor met with Staff regarding his plan to purchase the property at 3605 -- 29", Avenue NE
and his proposal to use the property for auto sales business for specialty cars, classics and custom models.
As he states in the attached letter, he plans to keep 1.5 to 25 vehicles on site for sale either in the show room
or parked on the west: side of tlae property during business hours. .`hese vehicles would. be ready for sale
and not junked vehicles. fie explained that h.e is planning to handle his inventory similarly to the Hitching
Post, ,vhcreby h.e would display lis veliicles outside duririg busirress hours and then store tli.en:i it:7side
during tl-Le off hours.
Mr. O'Connor was before the Planning Commission at the :March 151s Planning Commission for a concept
review to more fully discuss his plans for this property and to answer any questions or concerns the
Commission may have with his proposal.
In reviewing the Zoning Code, Section 1640 - Light industrial, 1640.02lists the permitted uses and one of
those is (a) Automotive service and repair provided no junked autos are kept on the property. Based on the
information provided by Mr. O'Connor, there was an indication that part of his proposed business would
include the "reconditioning" of classic or collectable cars. That would infer that Mr. O'Conraor does
propose to do auto- repair and service in order to bring an automobile to a saleable condition.
Further review of this Section, however, finds that only offices for administrative purposes and non -retail
business are permitted (Section 1640.02 (h)). It appears from the information submitted by the applicant
that a major portion of the proposed use will be devoted to retail.
Staff did receive a phone call from Glen Ward of Walter R. Hammond Company, at 360129th Avenue,
wl- ch is the property adjacent and directly to the west of the subject property. Mr. Ward was concerned
that due to the concrete boulevard on 29ut, prospective car buyers would turn onto 29h Avenue anti use his
driveway and parking lot to get to Mr. O'Connor's business rather than go further down the block to the
light, take a'U' turn and turn into the subject property's driveway. He was also concerned that parking
may become an issue as well, with the potential of these same buyers using his lot to park in, thereby
limiting parking for their customers. Finally, Mr. Ward felt that having a car lot next door would diminish
their property value.
3605 29th Avenue NE CUP 041905
