M <br />CITY OF ST. ANTHONY <br />RESOLUTION 05-044 <br />AMENDMENT TO DEVELOPMENT AGREEMENT <br />BETWEEN CITY OF ST. ANTHONY AND AMCON, LLC. <br />WHEREAS, the City Council and Amcon, LLC approved a development <br />agreement dated July 2003. <br />WHEREAS, the Development agreement obligated Amcon, LLC to construct a <br />6000 square foot restaurant on the pad lot by September 2005. <br />WHEREAS, Amcon, LLC has requested a change to the Development <br />Agreement to not build a 6000 square foot restaurant but instead <br />build a 4500 square foot retail center. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of St. Anthony to approve the <br />amendment to the development agreement with Amcon, LLC to <br />allow for a 4500 square foot retail center in return for a payment of <br />$100,000 said payment to be made to the City by July 13, 2005. <br />AMCON CONSTRUCTION <br />QI <br />CITY OF ST.
