CITY OF ST. ANTHONY <br />RESOLUTION 05-045 <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A <br />RESTAURANT WITHIN 250 FEET OF A RESIDENTIAL PROPERTY FOR THE <br />DEVELOPMENT LOCATED AT 2714 HIGHWAY 88. <br />WHEREAS, the St. Anthony Planning Commission held a public hearing on May 17, 2005, <br />regarding a conditional use permit to allow a restaurant within 250 feet of a <br />residential property for the development located at 2714 Highway 88; and <br />WHEREAS, the Planning Commission recommends Council approve the conditional use <br />permit to allow a restaurant within 250 feet of a residential property for the <br />development located at 2714 Highway 88 with the following conditions: <br />a. Garbage areas must be enclosed with materials that match buildings <br />and must be located on the southwest corner <br />b. Lighting must be "down spill', with no spillage to residential properties <br />across Kenzie Terrace and conform with adjacent area (St. Anthony <br />Boulevard) <br />c. No music or other artificial noise shall be audible from any residential <br />district <br />d. City engineers must approve the plan, including a determination that <br />the proposed plan will not have an adverse impact on the current water <br />run-off situation <br />e. Improve the landscape to the north side of the building <br />f. The design of the building shall conform with the exciting center <br />g. Hours of operation shall coincide with liquor service hours <br />h. Neon signage prohibited on west wall of building. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony hereby <br />approves a conditional use permit to allow a restaurant within 250 feet of a <br />residential property for the development located at 2714 Highway 88, as <br />recommended by the Planning Commission at their May 17, 2005 meeting. <br />Adopted this 14th day of June, 2005. <br />ATTEST:_ <br />City Clerk <br />Review for Administration: <br />Mayor <br />City Manager <br />
