CITY OF ST. ANTHONY <br />RESOLUTION 05-046 <br />A RESOLUTION APPROVING A VARIANCE FOR BUILDING SETBACK FOR THE <br />DEVELOPMENT LOCATED AT 2900 KENZIE TERRACE <br />WHEREAS, the St. Anthony Planning Commission held a public hearing on May 17, 2005, <br />regarding a variance for building setback for the development located at 2900 <br />Kenzie Terrace; and <br />WHEREAS, the Planning Commission had the following findings: <br />W <br />1. One rear yard setback (northwest corner of building) variance of 12 feet for <br />a proposed setback of 5 feet at the property line. <br />a. Undue hardship exists based on the following: <br />a. Circumstances creating the hardship is an irregular parcel with a <br />jog, not the result of owner/applicant <br />b. The variance, if granted, would not alter the essential character <br />of the locality as there is sufficient room at the property line and <br />adjacent buildings and streets. <br />c. Economic consideration alone is not the reason for the variance <br />request <br />d. Because of the overall shape of the parcel, the property cannot <br />be put to reasonable use without the need for variances. <br />b. The variance will maintain the spirit and intent of the zoning code. <br />c. The circumstances creating the need for the variance are unique to <br />this property because of its odd shape. <br />d. No signage on the north wall as described by applicant. <br />e. Continue working with the City on landscaping and connecting <br />sidewalks. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony <br />hereby approves the variance for building setback for the development located <br />at 2900 Kenzie Terrace. <br />Adopted this 14th day of June, 2005. <br />ATTEST: <br />City Clerk <br />Review for Administration: <br />Mayor <br />City Manager <br />
