NUNOUTIMMY <br />Date: May 4, 2005 <br />To: Mayor and Council <br />From: Captain John Ohl <br />Michael Mornson, City Manager <br />SUBJECT: Animal Nuisance Ordinance <br />As you are aware, the Police Department has suggested the following changes to <br />the animal ordinance 1210.010 Subd. 1. <br />The new language is as follows: <br />No person owning operating, having charge of, or occupying, any building <br />or premises shall keep or allow to be kept any animal which, shall, by any noise, <br />"unreasonably disturb the peace and quiet" shall include, but is not limited to, <br />the creation of any noise by any animal which can be heard by any person, <br />including Animal Control or any Law Enforcement Officer, from a location outside <br />the building or premises where the animal is being kept. Any animal noise, <br />which, occurs repeatedly over at least a five (5) minute period of time with a one <br />(1) minute or less laps of time between each animal noise during the five (5) <br />minute period will be considered a nuisance. <br />This language would then be followed by our current language starting with "any <br />female dog in heat....", but would exclude any language regarding notification. <br />This change provides an objective standard, the five minutes period of time, <br />which, we didn't previously have. <br />
