M <br />CITY OF ST. ANTHONY <br />ORDINANCE 2005-008 <br />AN ORDINANCE RELATING TO REZONING AND AMENDMENTS AMENDING <br />SECTION 1665.03 OF THE ST, ANTHONY CITY CODE <br />The City Council of the City of St. Anthony hereby ordains: <br />Section 1. <br />Scetion 1665.03 of the St. Anthony City Code shall be amended, by modifying subdivision 4, to <br />read as follows: <br />1665.03 Rezoning <lnd Amendments. <br />Subd, L Initiation. of Proceedings. Proceedings for amendment of the Zoning Code may <br />be initiated by (a) a petition of the owners of property to be rezoned or affected by <br />amendment; (b) a recommendation by the Planning COMInission; or (c) action of the <br />Council. <br />Subd. 2. Submission Requirements. All applications by a property owner for changes in <br />zoning must. be accompanied by a drawing showing the property to be affected and all <br />property within 350 feet of the boundaries of the affected property, a statement as to why <br />the zoning change is requested, and the fee set forth in Subsection 61.5.07. The <br />application will be referred by the Zoning Officer to the Planning Commission fora <br />public hearing. <br />Subd. 3. Public Hearin >. The public hearing will be held by the Planning Commission. <br />Notice of the hearing will be given in accordance with Section 115. The Planning <br />Connnission will then make a recommendation to the Council on the proposed changes. <br />Subd. 4. Council Action. A maiority €ou -fps affirmative vote of all members of the <br />Council is required to approve any rezoning or any other change in the Zoning Code, <br />except that the adoption or amendment of any portion of the Zoning Code that <br />changes all or part of the existing classification of a zoning district from residential <br />to either commercial or industrial requires a four-fifths maiority vote of all <br />members of the Council. <br />Subd. 5. Planned Unit Development. In a proceeding for the rezoning of a property under this <br />Section 1665.03, if the property is 3 acres or more in area and if the proceeding is pursuant to a <br />petition by the owner of the property to be rezoned, the City Council may require that the <br />property be designated as a Planned Unit Development under Section 1655, in which case the <br />City Council may also require the property owner to submit an application for a Planned Unit <br />Development approval in accordance with Section 1655. <br />
