LWINNUMMIZ MR-41 W-501111NAR MAC l WHEREAS, the St. Anthony Planning Commission held a public hearing on August 16, 2005, regarding a variance for building setback for the development located at 2900 Kenzie Terrace: and WHEREAS, the Planning Commission had the following findings: 1. One rear yard setback (northwest corner of building) variance of 12 feet for a proposed setback of 5 feet at the property line. Undue hardship exists based on the following: a. The property is currently somewhat blighted, poorly planned with regard to layout and is an overall detriment to the area. Undue hardship exists and is a result of an oddly shaped parcel that is generally triangular in shape with a rounded side. c. These circumstances were not caused by the applicant or property owner. MY The variance, if granted, would not alter the essential character of the locality, but would allow for a redevelopment of a blighted site with new, more aesthetically pleasing buildings. The property cannot be puff to reasonable use without the requested variance because even reconstructing the existing blighted buildings on their same footprints would require setback variances. e. Economic consideration alone is not the reason for the variance request Because of the overall shape of the parcel, the property cannot be put to reasonable use without the need for variances. Granting of the variance will keep within the spirit and intention.of the zoning code and further, it is with the City's Comprehensive Plan and continues the City's economic redevelopment efforts in this area. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony hereby approves the variance for building setback for the development located at 2900 Kenzie Terrace as recommended by the Planning Commission at their August 16, 2005 meeting.
