Honorable Mayor, St. Anthony Village City Council and Staff <br />clo: Mike Mornson, City Manager <br />33 01 Silver Lake Road <br />St. Anthony Village, MN 55418-1699 <br />e® Proposed Ordinance 06-002 —Prohibited Discharges int® Sanitary SewerSystem <br />WSB Project No. 1065-57 <br />Dear Honorable Mayor, City Council and Staff: <br />The purpose of this letter is to discuss the content of the attached Ordinance 06.002, addressing <br />prohibited discharges into the City's sanitary sewer system. This ordinance was created to <br />address the inflow and infiltration (FI) entering the City's sanitary sewers through illicit private <br />connections to the sewer. As you are aware, efforts to reduce FI, have been initiated by the City <br />in attempt to address a sanitary sewer surcharge and potential demand charge imposed by the <br />Metropolitan Council Environmental Services (MCES). The 2006 St. Anthony 1/1 Reduction <br />Plan identified illicit private connections as the primary source of F1 in the City and <br />recommended that action be taken to eliminate such connections. This ordinance provides legal <br />authority to the City so that it can administer a program to eliminate such connections. <br />The ordinance contains the following: <br />• Defines allowable discharges into the sanitary sewer system. <br />• Defines illicit connections to the sanitary sewer that typically contribute to PI. <br />• Defines the proper way to disconnect an illicit connection and states theproper <br />configuration for utilizing a sump -pump. <br />• States that the City has a right to inspect private property for illicit connections. <br />• States that the property owner of an illicit connection must correct the problem within a <br />specific timeframe or be subjected to a utility surcharge enforced by the City. <br />• Allows the City to conduct follow-up inspections to verify that the property remains <br />compliant with these rules. <br />• Defines a city -imposed surcharge of $100 per month and prohibits the issuance of city <br />permits if residents do not allow inspections to be performed by the City or if they do not <br />disconnect illicit connections. <br />• Allows waivers for parcels not able to meet the requirement due to public safety <br />concerns. <br />• Allows property owners a means to pay for disconnection work over 5 years by using an <br />assessment to the parcel. <br />• States that violations of this section are a misdemeanor and could be prosecuted by the <br />City in a criminal court. <br />Minneapo'bi St. CI0U#:IWPWIffiJ065-57ILTR St. Anthony 051606doc <br />Equal Oppo unity Employer <br />
