6�-1a <br />,NgM <br />OUESTFOR COUNCIL CONSIDERATION <br />Report D. 10/17/2006 <br />Agenda Section: VI., I <br />Meeting Date: 11/14/2006 <br />ITEM DESCRIPTION: <br />Ordinance 06-005; Manufactured Home Park Ordinance <br />MANAGER'S REVIEW: <br />Please find attached a proposed ordinance 2'006-005 in relation to the closure of a <br />manufactured home park. City 'Staff drafted this ordinance direction from the City Council. <br />A petition was presented to the City Council at the August 22, 2006, Council meeting. <br />Staff held meetings with property owners of the park as well as some of the homeowners on <br />September 19th and 20th. The City Attorney has reviewed the ordinance and his comments <br />are including in this packet. <br />In preparing the proposed ordinance,staff researched other ordinances from the cities <br />including Oakdale, Apple Valley, and Mounds View. Some of the highlights of the proposed <br />ordinance are as follows: <br />Section 526.02 - Provides for several definitions. <br />Section 526.03 - Provides for a nine-month notice to the city and owners of the <br />manufactured home in the park. <br />Section 526.04 & 526.05 - The closure statementpresented to planning commission for <br />review. Statement passed onto City Council who holds a public hearing within 90 <br />days after submitting it. <br />Section 526.06 - Mandates the park owner paying for relocation costs. <br />Section 526.07 - Alternate compensation mandates an appraisal of a manufactured <br />home for those that cannot relocate. <br />In addition to this ordinance, there are additional requirements in Minnesota Statutes <br />3270.95.
