She explained if the note were prorated, the rates would be $1.7 and $1.8 <br />2 million respectively. <br />3 <br />4 Motion by Commissioner Thuesen, seconded by Commissioner Gray, to adopt HRA Resolution <br />5 06-011, a Resolution Relating to a Fifth Amendment to a Redevelopment Agreement by and <br />6 among the City of St. Anthony, Minnesota, the Housing and Redevelopment Authority of the <br />7 City of St. Anthony, Minnesota, and Apache Redevelopment, LLC (the Developer), dated <br />8 December 19, 2003. <br />9 <br />10 Motion carried unanimously <br />11 <br />12 B. HRA Resolution 06-011; Amendment, Assumption, Easement, Park Management and <br />13 Maintenance Agreement. <br />14 <br />15 City Attorney Jay Lindgren explained this amends the park maintenance agreement that relates to <br />16 the area of the Silver Lake Village that includes Salo Park. He stated is primary the <br />17 responsibility of the City to maintain the sculpture created by Finnish Sculptor Sakari Peltola, <br />18 and assume liability for any personal injury that may be related to the sculpture. He explained <br />19 that the HRA is a parry to the underlying agreement and therefore the amendment is available for <br />20 consideration. <br />21 <br />22 Motion by Commissioner Horst seconded by Commissioner Stille, to adopt HRA Resolution 06- <br />23 012, a Resolution Relating to a First Amendment to an Assignment, Assumption, Easement, Park <br />24 Management, and Maintenance Agreement By and Between St. Anthony Retail Development, <br />25 LLC, Apache Park, LLC, the Housing and Redevelopment Authority of the City of St. Anthony <br />26 and the City of St. Anthony, Minnesota. <br />27 <br />28 Motion carried unanimously. <br />29 <br />30 V.
