23 <br />FINDINGS OF FACT <br />The Planning Commission recommends approval of the Kenzington s request for an <br />amendment to the Parking Plan of their original Development Plan to allow for up to an <br />additional 30 parking spaces, based on the following Findings of Fact and subject to the <br />conditions listed below: <br />Findings of Fact <br />1. The property is a PUD overlay located in an R-4 zone which permits the <br />multiple -family residential development. <br />2. The property has been a PUD R-4 since 1985. <br />3. The R-4 Zoning District with the PUD overlay allowed for a Parking Plan that <br />allowed for one (1) parking space per unit and some spaces for visitors. Since <br />this is a retirement community, it was determined in 1985 that one (1) space <br />per unit was sufficient. Experience of the last twenty (20) years has shown <br />that two (2) parking spaces per unit should have been the minimum. <br />4. The property size is not sufficient enough to allow for two (2) spaces per unit <br />but the Kenzington Association has asked to amend the Parking Plan to <br />allow up to thirty (30) additional parking spaces. <br />5. There was some objection to the project by the residents but the objections <br />were mostly due to the possibility of increased association dues. Staff <br />advised the callers that the City has no ability to affect the Board's decision <br />regarding increased dues. <br />Conditions <br />Property to continue in the same use as a PUD R-4. <br />2. Twenty-four (24) parking spaces may be installed without additional <br />approvals as long as they do not require any additional curb cuts. The six <br />(6) parking spaces that are planned for the south portion of the site may <br />require a curb cut installation. Any additional curb cuts will require <br />approvals and permits from the City of St. Anthony and Hennepin <br />County as Kenzie Terrace NE is County Road 153. <br />The property is located at 2601 Kenzie Terrace NE is Torrens property with a meets and <br />bounds legal. <br />Z:\Council Meeting s\2007\032707\Kenzington Findings of Fact Format 032007.doc <br />
