City Council Regular Meeting Minutes <br />September 25, 2007 <br />Page 2 <br />V. REPORTS FROM COMMISSION AND STAFF. <br />A. Ordinance 07-004• Text Amendment to Light Industrial Section 1640.02. <br />Planning Commissioner Jensen reported that if the proposed text amendment were approved, it <br />would allow daycare centers to be permitted conditional use in the Industrial Zoning District and <br />would require an approved CUP. <br />9 Councilmember Horst questioned whether this came before the Planning Commission as a <br />10 variance request first. <br />11 <br />12 Commissioner Jensen replied it came forward as a text amendment with different alternatives. <br />13 He stated the City Attorney provided a revised draft version for consideration. <br />14 <br />15 Councilmember Horst questioned what other uses might be similar. <br />16 <br />17 Commissioner Jensen replied certain categories of retail, office as a permitted use. Ile stated <br />18 most of the buildings in this area are office related uses. <br />19 <br />20 Councilmember Ilorst inquired as to whether the question was asked about usage that would <br />21 emit a smell that might affect the children. <br />22 <br />23 Commissioner Jensen Planning Commission felt that was not a specific issue as it related to the <br />24 text amendment because the conditional use permit criteria, should it be approved, would be the <br />25 time to evaluate whether it was an appropriate blend of the use. Ile stated most of the criteria <br />26 dealt with other environmental controls and moved away from that type of building. <br />27 <br />28 Mr. Robert Poster, 3308 Beldon Drive, stated he brought the text amendment forward. He <br />29 reported Mrs. Carol Arens, owner of the daycare, and Mr. Rod Lee would be part owners of the <br />30 building. IIe stated they looked at the character of the building would changed to predominantly <br />31 an office building site. He reported that approximately 20,000 square feet of the building would <br />32 not have an industrial character. He stated it is their desire over the next five years, to see if the <br />33 rest of the building could be converted to an office area also. He commented that Mrs. Arens <br />34 opened a second school in Blaine last week that is the prototype of the proposed building in St. <br />35 Anthony. <br />36 <br />37 Motion by Councilmember "fhuesen, seconded by Councilmember Gray, to approve Ordinance <br />38 07-004, an Ordinance Amending Chapter 16 of the City Code being Zoning and Land Use. <br />39 <br />40 Mayor Faust stated this is the first reading of this issue and two additional readings would occur. <br />41 <br />42 Councilmember Horst commented the primary problem created by the tenants was its proximity <br />43 to a daycare. IIe commented that he wonders if Council would be looking at problems down the <br />44 road as light industrial is technically retail. He stated there is a reason a daycare is currently not <br />45 located in light industrial. <br />46 <br />N <br />
