43 <br />The circumstances causing the hardship -are unique to the individual lot. The lot is an interior, residential lot. <br />There were a few lots platted smaller than the adopted 75 -foot minimum width and the situation seems to be <br />unique to those areas of town that began redeveloping from rural uses first. <br />The granting of the variance is in keeping with the spirit and intent of the Zoning Code. The Zoning Code was <br />adopted to protect the health, safety and general welfare of the City and its people. By granting this variance, <br />Mr. Schommer will be able to build a home that is more updated and code compliant than the existing dwelling <br />on the site.. <br />Action: Approve a recommendation to the City Council approving Mr. Schommer's request for a variance to <br />the City's Minimum Lot Width Ordinance based on the Planning Commission's Findings of Fact as derived <br />from information presented by the applicant and staff. <br />Communications: Staff received three phone calls asking about this variance application. Generally, the callers <br />were concerned that the variance meant that the property owner would be able to acquire property from adjacent <br />lots to make up the 7 -foot difference. Staff explained that the variance only gives the property owner an <br />exception from the Ordinance requirement for the width of his lot. <br />A resident voiced concerns at the public hearing over asbestos that may have been used when the house was <br />originally constructed.
