RIP
Econornic considerations alone are not the basis of the hardship. While the variance, if
approved, would increase the property values of this property and the neighborhood,
it is not the only consideration of the property owner. He currently lives at the subject
property and feels that to continue remodeling a house that is nearly 80 years old is not
practical.
The circumstances causing the hardship are unique to the individual lot. The lot is an
interior, residential lot. There were a number of smaller lots in St. Anthony Village
that were platted prior to the adopted 75 -foot minimum width. The situation seems to
be unique to those areas of town that first began redeveloping from rural uses.
The granting of the variance is in keeping with the spirit and intent of the Zoning
Code. The Zoning Code was adopted to protect the health, safety and general welfare
of the City and its people. By granting this variance, Mr. Schommer will be able to
build a home that is more updated and code compliant than the existing dwelling on
the site.
The Planning Commission stipulated that it would recommend approval of the variance request on
the condition that Mr. Schommer provides staff with a corrected survey map in time to include it in
the City Council's meeting packet for their consideration. Staff received the corrected survey map
showing a total side yard setback of 15.02 feet, with 9.15 feet on the west side and 5.87 feet on the east
side of the property on December 21, 2007.
F:\Planning\Findings of Fact\2008\01082008 Findings of Fact 3112 32nd Avenue Schommer.doc
