W. <br />Staff Report <br />To: Mike Morrison <br />From: John Malenick, Fire Chief <br />Date: March 27, 2008 <br />Re: Property Maintenance ordinance changes, second reading <br />_Property Maintenance Code: After the May 2007 Work session, staff was directed <br />to explore and propose possible changes to current city ordinances as they pertain <br />to property maintenance. Of particular concern was how the current code <br />addressed rental property and inspections. To this end, staff began researching <br />and planning new ordinances. <br />Proposed at the first reading of recommended changes (March 25, 2008) was the <br />addition of a new section to the City Codes (sec.1336). This new section will adopt <br />the International Property Maintenance Code (IPMC) as an enforceable document <br />as it pertains to St. Anthony rental property. Within this section are amendments to <br />the IPMC to reflect past St. Anthony practice and the licensing procedures for all <br />rental property. <br />Council discussion at the March 25th reading centered on the inclusion of non <br />owner occupied homes that are not rented into the licensing requirements. Staff <br />was then directed to explore language that would include into the <br />licensing/inspection process, any non owner occupied dwelling. <br />City attorney Jay Lindgren was then contacted for opinion and subsequently it was <br />agreed to modify the definition of Rental Unit to describe any dwelling that is not <br />owner occupied.
