Report on Compliance with Minnesota Legal Compliance <br />Audit Guide for Local Government <br />Page 2 <br />2007-9 Lack of Resolution Accepting Donations <br />Criteria: Minnesota statutes require that all grants or devise of real or personal property accepted <br />by the City be by resolution. MS 465.03 reads in part as follows: <br />465.03 Gifts to municipalities. <br />Any city, county, school district or town may accept a grant or devise of real or personal <br />property and maintain such property for the benefit of its citizens in accordance with the <br />terms prescribed by the donor. Nothing herein shall authorize such acceptance or use for <br />religious or sectarian purposes. Every such acceptance shall be by resolution of the <br />governing body adopted by a two-thirds majority of its members, expressing such terms in <br />full. <br />Condition: Pour donations received in 2007 were not accepted by the City by resolution. <br />Cause: The City has not implemented procedures to ensure that all donations or devise of' real or <br />personal property are being acccpted by the City by resolution. <br />Effect: The effect of noncompliance is not determinable. <br />Recommendation: We recommend the City consider altering procedures to comply with <br />Minnesota Statute 465.03. <br />Views of Responsible Officials and Correcfive Action Plan: The City has implemented <br />procedures to insure that all grants, gifts, donations or devises or real or personal property are <br />accepted by the City council by resolution. The resolutions will be approved at a regular council <br />meeting and be kept on file in the City clerk's office. <br />
