Chief of Police July 28, 2008 Gordon Blackey 3020 Croft Driver St. Anthony, MN 55418 Dear Mr. Blackey: The St. Anthony Police Department's records indicate that on the following dates your dog (black Lab mix) has bitten one or more persons (unprovol<ed): June 26, 2008; November '16, 2007 and May 18, 2007. As such, your dog has been declared a "dangerous dog" as described in MN State Statute 347.50. MN State Statute 347.54] provides that you may request a hearing concerning the "dangerous dog" declaration. Failure to request a hearing within 14 days fi-om the date of this notice, will terminate your hearing right. In addition, if you male an appeal request within the 14 day period, you must immediately comply with the requirements of MN State Statute 347.52 (a) (attached). If the hearing officer affirms the "dangerous dog" declaration, the animal must be immediately removed from the city limits of St. Anthony (ordinance #1205.02). In the event that the "dangerous dog" declaration is upheld by the hearing officer, the actual expenses of the hearing (up to a maximum of $1,000) will be the responsibility of the dog's owner. If the dog is currently being held by ow animal control, all actual costs of the care, keeping and disposition of the dog are the responsibility of the person claiming an interest in the dog, unless the court or hearing officer finds that the impoundment was not substantially justified by law.
