The alley is currently owned and maintained by the Arbor's <br />Homeowners Association. <br />The petition does not meet the guidelines for petitioned improvements as outlined in Minnesota State Statue <br />Chapter 429. The 429 'process states "an improvement must be petitioned for by the owners on not less than <br />35 percent in frontage real property abutting the street named in the petition". The Council may however <br />adopt a resolution accepting the requests listed in the petition and order the preparation of a Feasibility <br />Report by vote of four-fifths of all members of the Council.
