CITY OF ST. ANTHONY <br />RESOLUTION 09-019 <br />A RESOLU'T'ION TO "BOLD HARMLESS" THE STATE OF MINNESOTA FOR <br />GRANTING A VARIANCE FROM MINNESOTA RULES I+'OR STATE AID 8820.9920 <br />WHEREAS, the City of St. Anthony has applied to the Minnesota Department of <br />Transportation, State Aid for Local Transportation Office, for a Variance from <br />Minnesota Rules for State Aid Operations 8820.9920 as they apply to the proposed <br />reconstruction of Chandler Drive and Foss Road, between 37°i Avenue NE to the <br />east city limits. <br />WHEREAS, the variance requests to allow a 84' radius (20MPH) curve between stations 27+75 <br />and 28+45 and a 182' radius (25MPH) curve between stations 39+65 and 41 1-45 <br />within the project limits in lieu of the minimum 30 MPH (300' radius) design speed <br />as required by the rules. <br />WHEREAS, the Office of State Aid for Local Transportation has granted this variance <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Anthony that: <br />1) The City of St. Anthony does hereby indemnify, save and hold harmless the State of <br />Minnesota and its agents and employees of and from any and all claims, demands, actions, <br />or causes of action arising out of or by reason of granting this variance, and further agrees <br />to defend at their sole cost and expense, any action or proceeding commenced for the <br />purpose of asserting any claim of whatsoever character arising as a result of the granting <br />of this variance. <br />Adopted this day of 12009. <br />A'r'rES'r: <br />City Clerk <br />Reviewed for administration: <br />Mayor <br />City Manager <br />K:A0162609 019.Au <br />16 <br />
