STAFF REPORT <br />To: Mayor and City Council Report No.: <br />Mike Mornson, City Manger <br />From: Kim Moore -Sykes, Assistant City Manager <br />Date: February 24, 2009 <br />Subject: Request to Keep Three Hen Chickens <br />Background; <br />Staff received a written request from Mr. Todd Roepke, 3901 Foss Road, to be allowed to house three (3) hen <br />chickens. Included with his request, Mr. Roepke provided signature pages from some of his neighbors. He <br />also provided additional information regarding chickens as pets from various sources. Staff verified with <br />Mr. Roepke that these were neighbors that would be impacted by the chickens and that the address he <br />listed is where he will keep the chickens. He stipulated that he plans to keep only three hen chickens; no <br />rooster. <br />The City Ordinance is silent on the keeping of animals in any zoning district. Section 1210.02 Keeping of <br />Certain Animals just states that certain animals cannot be kept closer than 500 feet to any human habitation <br />or platted land, without the approval of the City Council. 3901 Foss Road is in the R-3 Zoning District and <br />there is nothing in the Ordinance regarding R-3 that restricts animals, such as chickens, from existing in that <br />zoning district. <br />Staff contacted Ramsey County and, like Hennepin County, indicated to Staff that approval of the request <br />was under the City's jurisdiction. Again, Staff had also checked with other communities surrounding St. <br />Anthony last summer in response to a similar request, to find out if those communities regulated chickens. <br />Generally, chickens were allowed until they created a nuisance or were not adhering to the setbacks as <br />established by that city's ordinance.
