Following this letter is a copy of the draft ordinance for your review. <br />As part of the MS4 General Permit enforced by the MPGA, the City of St. Anthony is required to establish a <br />program to identify and eliminate illicit and non -storm water discharges into the storm sewer. As part of this <br />program the MPGA requires implementation of an ordinance which will effectively prohibit illicit and non -storm <br />water discharges and provide the City with an appropriate amount of leverage to investigate and correct any <br />infractions. <br />The ordinance proposed to be codified by the City Council defines an illicit discharge as "Any direct or indirect non - <br />storm water discharge to the storm drain system. " The ordinance provides exemptions to the prohibition of illicit <br />discharges which include hydrant flushing, lawn watering, noncommercial washing of vehicles, swimming pools, <br />etc. <br />Provisions for monitoring of suspected illegal connections and illicit discharges are provided in the ordinance as <br />well. This language allows the City to access facilities and install monitoring equipment to ensure compliance of the <br />ordinance. <br />Enforcement of this ordinance includes a notice of violation process, an appeal process, cost of abatement <br />provisions, compensatory action, and criminal prosecution. <br />It is recommended that the draft ordinance be reviewed by the City Attorney to ensure that there are no conflicts <br />with existing City code. <br />If you have any questions in regard to this ordinance, I will be present at the February 24, 2009 Council Meeting to <br />discuss those with you or please call me at 763-287-7182. <br />Sincerely, <br />WS'B �& Associates, Inc. <br />Todd E.
