Action: Public Hearing on Conditional Use Permit Application <br />Date Application Received: April 20, 2009 <br />Property Address: 3055 Old US Hwy. 8 <br />Zoning District: Light Industrial <br />60 -Day Expires: June 19, 2009 <br />Waiver Letter Rewired: NA Yes; Sent: No <br />Future Action: Council Action: May 26, 2009 Council Meeting. <br />Background: Ms. Kalthum Jama, lkram Childcare, LLC, has requested a Conditional Use Permit to allow <br />Ikram Daycare to locate at 3055 Old US Hwy. 8. The subject property is zoned Light Industrial. The applicants <br />presented a CUP application to the Planning Commission at a public hearing held at the May 19, 2009 Planning <br />Commission meeting. <br />Application Review: <br />An application for the CUP was made on forms provided to Ms. Jama by Staff and deemed complete. The <br />public hearing notice for the May Planning Commission meeting was published in the City's legal newspaper and <br />notices were mailed to property owners adjacent to the property, as requited by state statute. The CUP <br />application was reviewed and considered with the following items in mind: <br />a.) The use is one of the conditional uses specifically listed for the district in which the property is <br />located. A text amendment was adopted by City Council in 2007 allowing daycare facilities as a <br />permitted conditional use in the Industrial Zoning District. <br />b.) The Council has specified all conditions which the Council deems necessary to make the use <br />compatible with other uses in the area. <br />c.) The use will not be detrimental to the health, safety, or general welfare of persons residing or working <br />in the vicinity or to the values of property in the vicinity. The applicant has argued that a <br />conveniently located daycare facility will not be detrimental in any way to the health, safety, or <br />general welfare of persons residing or working in the vicinity but rather will be welcomed by <br />employees with children who work and/or live in the area. <br />staff CUP Ikram Child Care <br />
