57 <br />CITY OF ST. ANTHONY VILLAGE <br />RESOLUTION 09-053 <br />RESOLUTION TO APPROVE THE REQUEST FOR CONDITIONAL USE PERMIT <br />(CUP) FOR IKRAM CHILD CARE, LLC LOCATED AT 3055 OLD US HIGHWAY 8. <br />WHEREAS, Ms. Kaltun Jama, owner of Ikram Child Care, LLC has submitted an <br />application for a Conditional Use Permit under City Code Subsection <br />152.142 (G) to allow childcare services business to be located in a <br />industrial zoned district; and <br />WHEREAS, the City of St. Anthony Planning held a Concept Review on March 17 <br />2009 to review Ms. Jamas request; and <br />WHEREAS, on May 19, 2009, the Planning Commission conducted a public hearing <br />on the proposed CUP; and <br />WHEREAS, all required public notices regarding the public hearing were posted and <br />sent as required by State Statute; and <br />WHEREAS, the Planning Commission has recommended approval of the proposed <br />CUP to the City Council upon the conclusion of the public hearing; and <br />WHEREAS, the City Council received the Planning Commission's recommendation, <br />additional written and verbal testimony from the applicant and other <br />interested persons, and upon consideration of the application and <br />supporting materials, Staff's report, and all other information constituting <br />the record of this application; and <br />WHEREAS, the City Council upon further deliberation, voted to recommend the <br />requested Conditional Use Permit and directed the preparation of the <br />Findings of Fact and this resolution as a contemporaneous record of the <br />Council's decision, and <br />BE IT RESOLVED that the City Council of the City of St. Anthony does hereby <br />Adopt the following Findings of Fact related to the requested CUP: <br />Findings: <br />1. Subsection 151.142 (G) in the Industrial Zoning District lists daycare <br />centers without drive-through facilities as an allowed use in the <br />Industrial' District under a CUP. <br />2. The issuance of a Conditional Use Permit under Subsection 152.243 of the <br />City's Zoning Code requires the consideration of the following items: <br />
