WR • 9 , STATE OF • n RESOLUTION 09-028 RESOLUTION FOR APPROVAL OF THE REQUEST FOR AN ADMINISTRATIVE LOT SPLIT FOR THE PROPERTY LOCATED 3055 OLD US HIGHWAY 8 WHEREAS, a Public Hearing was scheduled for this lot split request before the City of St. Anthony Planning Commission on January 20, 2009; and WHEREAS, the Applicant requested that the Planning Commission table the Public Hearing until February 17, 2009 to prepare a parking analysis for proposed Lot B; and WHEREAS, the Planning Commissioners voted to table the Public Hearing for the Wirth Company's lot split request until February 17, 2009; and WHEREAS, the rescheduled Public Hearing was held on February 17, 2009 at 7:04 pm; and WHEREAS, the Applicant did not show up to the rescheduled Public 1-1earing and did not provide Staff with the parking analysis for Lot B to be presented at the rescheduled Public Hearing; and WHEREAS, the majority of the Planning Commissioners voted to recommend denial of the proposed Lot Split at 3055 Old US Highway 8; and WHEREAS, the Applicant presented the lot split request to the City Council at the regularly scheduled Council Meeting on February 24, 2009 and admitted that due to a misunderstanding, he missed the Public Hearing scheduled for this item with the Planning Commission on February 17,2009; and WHEREAS, the Applicant requested that the City reconsider the application for lot split at 3055 Old US Highway 8; and WHEREAS, the City Council directed Staff to reschedule a Public Hearing with the Planning Commission at their regularly scheduled meeting on March 1.7, 2009; and WHEREAS, the majority of the Planning Commissioners voted to recommend approval of the proposed Lot Split at 3055 Old US Highway S. BE IT RESOLVED, that the City Council of the City of St. Anthony does hereby agree with the Planning Commission's recommendation; and
