30 <br />CITY OF ST. ANTHONY VILLAGE <br />STATE OF MINNESOTA <br />RESOLUTION 09-028 <br />RESOLUTION FOR DENIAL OF THE REQUEST FOR AN ADMINISTRATIVE LOT <br />SPLIT FOR THE PROPERTY LOCATED 3055 OLD US HIGHWAY 8 <br />WHEREAS, a Public Hearing was scheduled for this lot split request before the City of <br />St. Anthony Planning Commission on January 20, 2009; and <br />WHEREAS, the Applicant requested that the Planning Commission table the Public <br />Hearing until February 17, 2009 to prepare a parking analysis for <br />proposed L,ot B; and <br />WHEREAS, the Planning Commissioners voted to table the Public Hearing for the <br />Wirth Company's lot split request until February 17,2009; and <br />WHEREAS, the rescheduled Public Hearing was held on February 17, 2009 at 7:04 pm; <br />and <br />WHEREAS, the Applicant did not show up to the rescheduled Public Hearing and did <br />not provide Staff with the parking analysis for Lot B to be presented at <br />the rescheduled Public hearing; and <br />WHEREAS, the majority of the Planning Commissioners voted to recommend denial <br />of the proposed Lot Split at 3055 Old US Highway 8; and <br />WHEREAS, the Applicant presented the lot split request to the City Council at the <br />regularly scheduled Council Meeting; on February 24, 2009 and admitted <br />that due to a misunderstanding, he missed the Public Hearing scheduled <br />for this item with the Planning Commission on February 17, 2009; and <br />WHEREAS, the Applicant requested that the City reconsider the application for lot <br />split at 3055 Old US Highway 8; and <br />WHEREAS, the City Council directed Staff to reschedule a Public I -fearing with the <br />Planning Commission at their regularly scheduled meeting on March 17, <br />2009; and <br />WHE'R'EAS, the majority of the Planning Commissioners voted to recommend denial <br />of the proposed Lot Split at 3055 Old US Highway 8. <br />BE IT RESOLVED that the City Council of the City of St. Anthony does hereby agree <br />with the Planning Commission's recommendation; and <br />
