CITY OF ST. ANTHONY VILLAGE <br />ORDINANCE 2010-002 <br />AN ORDINANCE IMPOSING A MORATORIUM ON <br />THE ISSUANCE OF LICENSES FOR PIPE AND TOBACCO SHOPS <br />The City Council of the City of St. Anthony hereby ordains: <br />Section 1. Recitals. Under Section 152.121 of the Zoning Code, pipe and tobacco shops are <br />permitted uses in the Commercial District. The City Council has authorized a study to be <br />conducted for the purpose of considering amendments to the Zoning Code with respect to the <br />regulation of pipe and tobacco shops. Under Minnesota Statutes, Section 462.355, subd. 4, if a <br />city has authorized a study to be conducted for the purpose of considering amendments to its <br />zoning code, the governing body of the city may adopt an interim ordinance for the purpose of <br />protecting the planning process and the health, safety and welfare of its citizens. The interim <br />ordinance may regulate, restrict or prohibit any use, development or subdivision within the city <br />or any portion thereof for a period not to exceed one year from the date it is effective. <br />Section 2. Moratorium Imposed. For the purpose of protecting the planning process while <br />the City is conducting a study for the purpose of considering amendments to the Zoning Code <br />with respect to the regulation of pipe and tobacco shops, a moratorium is imposed on the <br />issuance by the City of licenses for new pipe and tobacco shops pursuant to the authority <br />contained in Minnesota Statutes, Section 462.355, subd. 4. This moratorium shall be in effect for <br />a period of one year from the effective date of this ordinance unless earlier terminated by the <br />City Council. <br />Section 3. Effective Date.
