Morrison, City Manager <br />From: Kim Moore -Sykes, Assistant City Manager <br />Date: July 27, 2010 <br />Subject: 3701 Stinson Boulevard — Conditional Use Permit (CUP) Request for a Restaurant Located <br />within 250 Feet of a Residential Structure or District (City Code 152.122, (P)} <br />Requested Action: Approval of a Conditional Use Permit Request for a Restaurant <br />Located within 250 Feet of a Residential Structure or District. <br />Date Application Received: <br />Property Address: <br />Zoning District: <br />60 -Day Expires: <br />Waiver Letter Required: <br />Future Action: <br />June 22, 2010 <br />3701 Stinson Boulevard <br />Commercial <br />August 20, 2010 <br />Yes_ Date Sent: _ No X <br />Background Mr. Tent' Abney of Abney Development Services, Inc., consultant and construction manager <br />for International House of Pancakes restaurants appeared before the Planning Commission in a public <br />hearing to discuss IHOP's request for a Conditional Use Permit to allow the location of an IHOP restaurant <br />at 3701 Stinson Boulevard, which is less than 250 feet from a residential district (City Code 152.122, (P)}. <br />This site was previously the location of Baker s Square restaurant that closed in 2009. <br />Coin inunications: Four residents attended the public hearing and one of them did come to the podium <br />and state that they were in attendance to support approval of the conditional use permit requests from <br />IHOP. Staff reported that six telephone calls were also received in support of IHOP's CUP request. <br />Action: The Planning Commission voted unanimously to recommend approval of the conditional use <br />permit (CUP) request for a restaurant located within 250 Feet of a residential structure or district (City Code <br />152.122, (P)) <br />Attachments: <br />• Resolution 1.0-052; Approving a Conditional Use Permit for a Restaurant located within 250 feet <br />from a Residential Structure or District for the property located at 3701 Stinson Boulevard. <br />Staff Report 111011 250 feet residential dist CUP <br />
