30 <br />cheroots; stogies, perique; granulated, plug out, crimp cut, ready -rubbed, and other smoking <br />tobacco; and any product or formulation of matter containing biologically active amounts of <br />nicotine that is manufactured, sold, offered for sale, or otherwise distributed with the expectation <br />that the product or matter will be introduced into the human body, but does not include any <br />cessation product approved by the United States Food and Drug Administration for use as a <br />medical treatment to reduce and eliminate nicotine or tobacco dependence." <br />Section 4. Amendment of Section 111.047 of St Anthony City Code. Section 111.047 of the <br />St. Anthony City Code, shall be amended to read as follows: <br />"§ 111.047 LICENSE REQUIRED. <br />(A) Generally. No person may directly or indirectly or by means of any device keep for <br />retail sale, sell at retail, offer to sell or otherwise dispose of any tobacco, tobacco <br />products, or tobacco related devices, at any place in the City unless a license has first <br />been issued by the City Council as provided in this section. <br />(B) Specifically. <br />(1) Application. An application for a license to sell tobacco, tobacco products, <br />and tobacco related devices shall be made on a form provided by the City. The <br />application shall contain the full name of the applicant, the applicant's residential and <br />business addresses, and telephone numbers, the name of the business for which the <br />license is sought, and any additional information the City deems necessary. <br />(2) Action. The City Council may either approve or deny the license, or it may <br />delay action for any reasonable period of time as necessary to complete any investigation <br />of the application or the applicant that it deems necessary. if the City Council approves <br />the application, the Licensing Clerk shall issue the license to the applicant. If the City <br />Council denies the application, notice of the denial shall be given to the applicant along <br />with notice of the applicant's right to appeal the City Council's decision. <br />(3) Term. All licenses issued under this subchapter shall be valid for 1 calendar <br />year from the date of March 15. <br />(4) Revocation or suspension. Any license issued under this subehapter may be <br />revoked or suspended as provided in § 111.056. <br />(5) Transfers. All licenses issued under this section shall be valid only on the <br />premises for which the license was issued and only for the person to whom the license <br />was issued. No transfer of any license to an other location or person shall be valid <br />without the prior approval of the City Council. <br />(6) Moveable place of business. No license shall be issued to a moveable place <br />of business. Only fixed location businesses shall be eligible to be licensed under this <br />subchapter. <br />-2- <br />
