33 <br />CITY OF ST. ANTHONY VILLAGE <br />ORDINANCE 2011-06 <br />AN ORDINANCE AMENDING SECTION <br />152.245(C) OF THE ST. ANTHONY CITY CODE <br />Section 2. Amendment of Section 152.245(0) of St. Anthony City Code. Section 152.245(C) of <br />the St. Anthony City Code shall be amended to read as follows: <br />"(C) Evidence. No variance will be granted unless the evidence presented discloses all <br />of the following facts. <br />(1) The subject matter of the application is within the scope of this section. <br />(2) Strict enforcement would cause-un4ue4adship practical difficulties because: <br />(a) The property eannot be put to a feasonab! host -thea na ce:ew}rer <br />proposes use -easenable-tanner•-net-pe :tt <br />zening-cede; owner proposes to use the property in a reasonable manner <br />not permitted by the zoning code; <br />(b) The eiFeurnstanees causing the' F ere–not-oreated-by-the-ewner; <br />The plight of the property owner is due to circumstances unique to the <br />property not created by the property owner; <br />(c) The variance, if granted, will not alter the essential character of the <br />locality; and/or <br />(d) Economic considerations alone are not the basis of the hardship practical <br />difficulties. <br />(3) Thecircumstances causing the hardshipare- n t.. tr... .,.7: ;.7, .,1Prepe..ry <br />unarm sideration variance, if granted, would be consistent with the City's comprehensive land <br />use plan. <br />(4) The granting of the variance is in ke-epirig-mi"e-spifWharmony with the general <br />purposes and intent of the zoning code." <br />Section 3. Effective Date. This ordinance shall become effective as of its date of adoption. <br />
