CITY OF ST. ANTHONY VILLAGE <br />RESOLUTION 11-051 <br />RESOLUTION FOR APPROVAL OF A GARAGE SETBACK PERMIT TO ENCROACH INTO <br />THE SIDE YARD SETBACK AND REAR SETBACK AT 2609 PAHL AVENUE <br />WHEREAS, on August 16, 2011 the Planning Cormnission held a public hearing to consider a <br />request for a 1.2 foot variance to the side yard setback and a 1.4 foot variance into <br />the rear setback for 2609 Pahl Avenue according to 152.176(b); and <br />WHEREAS, the applicants presented their request for a variance so that they could build a <br />detached double car garage to replace the existing detached single car garage; and <br />WHEREAS, the plight of the property owner is due to circumstances unique to the property not <br />created by the property owner. The current structure was built in 1952; and <br />WHEREAS, the variance would not alter the essential character of the neighborhood and <br />the proposed garage will be essentially in the same location as the current <br />structure. This will keep the sight lines along the alley the same so as to not <br />affect their ability to use the alley; and <br />WHEREAS, economic considerations alone are not the basis of the practical difficulties. <br />The variance would be consistent with the City's comprehensive land use <br />plan. The City recognizes that attached and detached garages are <br />appropriate uses in the residential zoning districts; and <br />WHEREAS, granting this variance is in harmony with the general purpose and intent of the <br />Zoning Code. The City has demonstrated by implementing 152.176 (b) that double <br />car garages are desirable and beneficial to the community; and <br />WHEREAS, the Planning Corrunissioners unanimously voted to recommend approval of a 1.2 <br />foot variance to the side yard setback and a 1.4 foot variance into the rear setback <br />for 2609 Pahl Avenue. <br />BE IT RESOLVED, that the City Council of the City of St. Anthony approves of a garage setback <br />permit to encroach into the side yard setback and rear setback at 2609 Pahl Avenue. <br />Adopted this 23rd day of August, 201.1 <br />M <br />City Clerk <br />Review for Administration: <br />Mayor <br />Interim City Manager <br />32 <br />
