M <br />CITY OF ST. ANTHONY <br />STATE OF MINNESOTA <br />RESOLUTION 11-059 <br />RESOLUTION FOR APPROVAL OF THE REQUEST FOR A VARIANCE TO FRONT <br />YARD SETBACK FOR STEPS AND STOOP FOR 3408 MAPLEWOOD DRIVE NE <br />WHEREAS, a Public Hearing was scheduled with the Planning Commission for <br />September 20, 2011 and commenced at 7:25 PM to consider the property <br />owners' request for a 2'10"variance to the front yard setback for the <br />construction of stoop and steps; and <br />WHEREAS, the applicants presented a site plan showing the proposed addition of a <br />front porch and stoops with steps; and <br />WHEREAS, the applicants will require a variance of 2'9.5" variance to the City's front <br />yard setback; and <br />WHEREAS, the City Ordinance does allow a 5' eneroaclnnent into the front yard for <br />stoops, steps, and porches, but the construction of a front porch with <br />stoops and stairs does not allow for a reasonably sized porch with steps <br />and a stoop within the allowed 5' encroachment. <br />WHEREAS, the applicants provided a written statement as required by MN statutes <br />describing their reasons why they have a unique situation with their <br />property, that strict enforcement would cause practical difficulties in <br />reasonably using their property, that the property cannot be put to a <br />reasonable use without the variance, that the circumstances causing the <br />practical difficulties were not created by the owners, that the variance, if <br />granted, will not alter the essential characteristics of the neighborhood, <br />that the economic considerations alone are not the basis of the practical <br />difficulties; and <br />WHEREAS, staff received no opposition to the applicants' proposed front porch with <br />a stoop and steps; and <br />WHEREAS, the Planning Commissioners voted unanimously to recommend approval <br />of the 2'9.5" variance to the front yard setback; and <br />BE IT RESOLVED, that the City Council of the City of St. Anthony does hereby agree <br />with the Planning Commission's recommendation; and <br />BE IT FURTHER RESOLVED that the City Council of the City of St. Anthony does <br />
