ME <br />CITY OF ST. ANTHONY <br />STATE OF MINNESOTA <br />RESOLUTION 11-060 <br />RESOLUTION FOR DENIAL OF THE REQUEST FOR A GARAGE SETBACK PERMIT <br />AND VARIANCE TO THE 528 SF MAXIMUM ALLOWED FOR A GARAGE SETBACK <br />PERMT FOR 2610 - 30111 AVENUE NE <br />WHEREAS, a Public Hearing was scheduled with the Planning Commission for <br />September 20, 2011 and commenced at 7:08 PM to consider the property <br />owners' request for a Garage Setback Permit; and <br />WHEREAS, the applicants presented a plan build a seven hundred sixty-eight (768) <br />square foot garage in the rear setback of their property at 2610 - 30th <br />Avenue NE; and are requesting a two hundred forty (240) foot variance to <br />the 528 SF maximum for garages in the rear or side setbacks as described <br />Subd. 1.52.176 (F); and <br />WHEREAS, the applicants also require a variance of 2.8% to the City's lot coverage <br />ordinance Inuit of 35% for residential lots of 9,000 SF or more; and <br />WHEREAS, the applicants provided a written statement as required by MN statutes <br />describing their reasons why they have a unique situation with their <br />property, that strict enforcement would cause practical difficulties in <br />reasonably using their property, that the property cannot be put to a <br />reasonable use without the variance, that the circumstances causing the <br />practical difficulties were not created by the owners, that the variance, if <br />granted, will not alter the essential characteristics of the neighborhood, <br />that the economic considerations alone are not the basis of the practical <br />difficulties; and <br />WHEREAS, staff received a letter from a neighbor opposing the applicants' proposed <br />garage plan as too large and not characteristic of the locality; and <br />WHEREAS, the Planning Commissioners voted unanimously to recommend approval <br />of the proposed two hundred forty (240) foot variance to the 528 SF <br />maximum garage size as specified in the Garage Setback Permit on the <br />condition that the applicants reduce the amount of lot coverage to 35%; <br />and <br />WHEREAS, staff received a revised site plan showing the reduction of the lot <br />coverage amount from 37.8% to the required 35%. <br />BE IT RESOLVED, that the City Council of the City of St. Anthony does not hereby agree <br />with the Planning Commission's recommendation; and <br />
