WHEREAS, 3. The variance, if granted, will not alter the essential characteristics of <br />the locality. The applicant stated Chandler Place is committed to <br />providing a safe, protected access for residents and visitors; and <br />WHEREAS, 4. Economic considerations alone are not the basis of the practical <br />difficulties, that the owner is willing to pay for improved safety and <br />enhance the appearance of the facility; and <br />WHEREAS, 5. The circumstances causing the hardship are unique to the individual <br />property. The applicant reported that the setbacks are unique to the <br />property and are not created by the property owner. The current thirty <br />(30) foot setback was not a requirement when the building was originally <br />designed and constructed; and <br />WHEREAS, 6. The granting of the variance will not alter the essential character of the <br />locality. It will improve the character of the area by enhancing the <br />appearance of the facility; and <br />WHEREAS, the Planning Commissioners unanimously voted to recommend approval <br />of the proposed twenty-five (25) foot variance to the Front Yard Setback <br />Encroachment for 3701 Chandler Drive. <br />BE IT RESOLVED, that the City Council of the City of St. Anthony does hereby agree <br />with the Planning Commissions recormnendation; and <br />BE IT FURTHER RESOLVED that the City Council of the City of St. Anthony does <br />hereby approve the twenty-five (25) foot variance to the Front Yard <br />Setback Encroachment for 3701 Chandler Drive. <br />Adopted this 25th day of October 2011 <br />ATTEST: <br />City Clerk <br />Reviewed for administration: <br />Mayor <br />Interim City Manager <br />41 <br />
