56 <br />STAFF REPORT <br />To: Mayor and City Council <br />Jay Hartman, Interim City Manager <br />From: Kim Moore -Sykes <br />Date: October 25, 2011 <br />Subject: Garage Setback Permit and Variance Request for Garage Size <br />3219 Stinson Boulevard NE <br />Requested Action: <br />Date Application Received: <br />Property Address: <br />Zoning District: <br />60 -Day Expires: <br />Waiver Letter Required: <br />Future Action: <br />City Council Approval <br />September 30, 2011 <br />3219 Stinson Boulevard NE <br />R-1 <br />November 28, 2011 <br />Yes_ Date Sent: _ No X <br />Background. <br />Ms. Rachel Sanzone, property owner of 3219 Stinson Boulevard, is requesting a Garage Setback Permit and <br />a 308 SF variance to rebuild her garage that was severely damaged in one of this year's summer storms. <br />She had originally requested a building permit to rebuild but when Staff was reviewing Ms. Sanzone's <br />building permit application, they discovered that a previous owner had built a 396 SF 'garage addition to <br />an existing garage in 2003. <br />Ms. Sanzone, who purchased the property two years ago, was called and advised that she could not rebuild <br />the size of garage that she previously had, as it had been built illegally. She responded that she used the <br />garage and expected to be able to replace it; that she had called her insurance company about the storm <br />damage and had contractors ready to start rebuilding. <br />Analysis. <br />Ms. Sanzone testified that she was not aware at the time of purchase that the garage was illegally built and <br />stated that the garage was the reason that she bought the property. <br />Ms. Sanzone's lot is 50' x 163' or 8,150SF; is an interior lot; is non -conforming due to its width and total area; <br />and has a maximum lot coverage of 40%.
