He is building a home on these lots and would like to have all the lots combined so <br />that he would receive one property tax statement. <br />Analysis: <br />Staff researched the City's Zoning Ordinance and contacted the City Attorney. 'The Attorney suggested that itis <br />a simple process to combine residential lots as long as in the process, non conforming lots are not created. As <br />stated previously, the combination is to create one conforming lot and one tax statement. Mr. Alm's lots ate all <br />interior R-1 lots and each is less than the required 9,000 SP lot area. Mr. Alm stated that he has no wish to <br />subdivide them again once they are combined as he is building a house. <br />The City Attorney advised that doing an Administrative Lot: Combination is a matter of having the Planning <br />Commission review the proposal, send on a recommendation to the City Council, and requesting the City <br />Council approve the lot combination by resolution. By combining these lots, Mr. Alin would create a single, R-1 <br />interior lot that: is 22,842 SF. <br />X151.08 of the City's Zoning Code states that the City Council may waive compliance with the platting <br />requirements and approve subdivision by conveyance of land by adoption of a resolution that in effect, based on <br />findings by the City Council that: <br />a. Compliance with the platting requirements would create an unnecessary hardship or expense because <br />of the nature of the subdivision; and <br />b. Failure to requite the filing of a plat does not interfere with the purposes of this subchapter. <br />
