22
STAFF REPORT
To: Mayor and City Council
Jay Hartman, Interim City Manager
From: Kiln Moorc-Sykes, Assistant City Manager
Date: November 15, 2011
Subject: Subdivision without Platting Request — 3629 Roosevelt Street NF,
Requested Action:, City Council Approval by Resolution
Date Apjnlication Received:
P101etty Address:
Lonin District:
60 -Day Expires:
Waiver Tetter Ttepuircd:
Future Action:
N/A
3629 Roosevelt Street NT
R-1
N/A
Yes Date Sent: No
Background:
Mr. Larry Alin contacted Staff askingif there was a way to combine the five (5) lots that make up his property at
3629 Roosevelt Street NE. He is building a home on these lots and would like to have all the lots combined so
that he would receive one property tax statement.
Analysis:
Staff researched the City's Zoning Ordinance and contacted the City Attorney. 'The Attorney suggested that itis
a simple process to combine residential lots as long as in the process, non conforming lots are not created. As
stated previously, the combination is to create one conforming lot and one tax statement. Mr. Alm's lots ate all
interior R-1 lots and each is less than the required 9,000 SP lot area. Mr. Alm stated that he has no wish to
subdivide them again once they are combined as he is building a house.
The City Attorney advised that doing an Administrative Lot: Combination is a matter of having the Planning
Commission review the proposal, send on a recommendation to the City Council, and requesting the City
Council approve the lot combination by resolution. By combining these lots, Mr. Alin would create a single, R-1
interior lot that: is 22,842 SF.
X151.08 of the City's Zoning Code states that the City Council may waive compliance with the platting
requirements and approve subdivision by conveyance of land by adoption of a resolution that in effect, based on
findings by the City Council that:
a. Compliance with the platting requirements would create an unnecessary hardship or expense because
of the nature of the subdivision; and
b. Failure to requite the filing of a plat does not interfere with the purposes of this subchapter.
