Title XV, Chapter 152, Section 152.142 (Permitted Conditional Uses LI Light Industrial <br />District) <br />This section of the City Code needs to be modified to reflect the direction provided by the <br />Planning Commission and the City Council to remove assembly, meeting lodge, or convention <br />halls as a permitted conditional use. The current text reads as follows: <br />I'he following uses are permitted in an LI District only by a conditional use permit issued by <br />the City Council: <br />(G) Assembly, nneeting lodge, or convention halls; <br />(11) Catering operations and in-house cafeterias not intended for retail or public use; <br />(1) Day-care center without drive-through facilities. <br />Staff recommends eliminating references to assembly, meeting lodge or convention hall (noted in <br />st++heflwo gh tex!) and re -lettering the remaining permitted conditional uses (noted in italics). <br />Staff recommends the following text to replace what is currently in the City Code: <br />The following uses are permitted in an IA District only by a conditional use permit issued by <br />the City Council: <br />('=`b-meett+gfedge s,,.,,�,., aNf <br />(1 y (G) Catering operations and in-house cafeterias not intended for retail or public use: <br />(I) (11) Day-care center without drive-through facilities. <br />DISCUSSION <br />The revised definitions and changes to the City Code are intended to show that there is a clear intent for <br />various land uses allowed in residential, commercial and industrial districts. By removing all assemblies <br />from the Light Industrial District and allowing all assemblies (secular and religious) in the Commercial <br />District, the City Code should also be in compliance with the Religious Land Use and hnstitutionalized <br />Persons Act (RLUIPA). <br />Staff has consulted with the City Attorney on the proposed changes, and Inas concluded that they are <br />consistent with the direction provided by the Planning Commission, City Council, and with federal law. <br />ACTION <br />1. Approve the Recommended Changes to the City Code. In the event of a recommendation for <br />approval, the City Council may refer to Exhibit A and may modify the recommended ordinance <br />as it deems necessary. <br />2. Request Additional Information. In the event the City Council finds that there are unresolved <br />issues regarding the proposed changcs by staff, the City Council should continue the meeting <br />until a later time. <br />ATTACHMENTS <br />Exhibit A: Recommended ordinance changes <br />
