CITY OF ST. ANTHONY <br />RESOLUTION 12-015 <br />RESOLUTION TO DENY A VARIANCE TO THE SIGN ORDINANCE <br />TO ALLOW A SECOND IDENTIFICATION SIGN FOR <br />HENNEPIN COUNTY MEDICAL CLINIC <br />AT THE MARKET PLACE SHOPPING CENTER <br />WHEREAS, Mr. Richard Lang of Visual Communications contacted City staff advising <br />them that Hennepin County Medical Clinic is locating at the Market Place <br />Shopping Center and wanted to discuss the need for a second identification <br />sign; and <br />WHEREAS, Staff advised Mr. Lang that City Ordinance § 155.29 (I3) (1) allows only one <br />identification sign; and <br />WHEREAS, Mr. Lang, as the representative for Hennepin County Medical Clinic <br />applied for a variance to the City's Sign Ordinance to allow for a second <br />identification sign; and <br />WHER13AS, the Planning Commission held a public hearing on the variance request on <br />December 20, 2011; and <br />WI IEI2LAS, The City Council convened at its regularly scheduled Council meeting on <br />January 10, 2012, and determined that the Hennepin County Medical <br />Clinic's request for a variance to the sign ordinance to allow a second <br />business identification sign did not met the criteria as specified in the City <br />Code's Zoning Ordinance. Subdivision § 152.245 (C) states that no variance <br />will be granted unless evidence presented supports that strict enforcement <br />of the City Ordinance would cause practical difficulties for the applicant. <br />L The City Council determined that the property can be put to a <br />reasonable use without the variance despite the architectural <br />design of the building; <br />2. The Council agreed that the circumstances causing the practical <br />difficulty were not created by the tenant; <br />3. The Council did feel that the variance, if granted, would alter the <br />essential characteristics of the locality because at present, all <br />tenants at the Market Place Shopping Center have only one <br />business identification sign; <br />4. The Council also agreed that economic considerations alone are <br />not the basis for the practical difficulty; <br />5. The Council did agree that the circumstances causing the <br />situation are unique to the individual lot; and <br />
