17 <br />JOINT POWERS AGREEMENT BETWEEN <br />RAMSEY COUNTY AND CITY OF SAINT ANTHONY <br />FOR USE OF YARD WASTE MANAGEMENT SITES <br />USING THE CITY'S ALLOCATION OF SCORE FUNDS <br />This Agreement is entered into pursuant to Minnesota Statutes Section 471.59 between Ramsey <br />County (the "County"), a political subdivision of the State of Minnesota, and the City of Saint <br />Anthony (the "City"), a political subdivision of the State of Minnesota. <br />Whereas, Ramsey County operates a yard waste management system, which includes <br />seven sites for the collection of yard waste from Ramsey County residents; and <br />Whereas, Ramsey County provides a portion of its SCORE funds to municipalities for <br />SCORE related activities, and uses some of its SCORE funds for the operation of the County's <br />yard waste sites; and <br />Whereas, the Ramsey County Solid Waste Management Plan states that "Ramsey County <br />will operate a system of yard -waste sites that are convenient, provided at no charge to site users, <br />and only for residents of Ramsey County," and <br />Whereas, a portion of the City of Saint Anthony is within Ramsey County, and City <br />residents within that area inay use the County's yard waste sites, but those City residents not in <br />Ramsey County are not allowed to use the County's yard waste sites; and <br />Whereas, the City would like to provide additional yard waste management opportunities to <br />all of its residents, whether they reside in Ramsey County or Hennepin County, and <br />Whereas, Ramsey County is willing to make yard waste services available to the City of <br />Saint Anthony for a reasonable cost, and provide an exception to the policy identified above to <br />address the practical difficulties of providing yard waste services for residents of the City because <br />this City has significant population in the two counties; and. <br />Whereas, the City would forgo using SCORE funds for any purpose other than making the <br />Ramsey County yard waste sites available to all of its residents, Now, therefore, it is agreed: <br />COUNTY OBLIGATIONS <br />a. The County shall allow all residents of the City, regardless of county of residence, to use <br />County yard waste sites at the same level of service that the sites are available to County <br />residents. <br />b. The County will provide the City with information about site services, hours and dates of <br />operation, and site rules, for use by the City in promoting the sites. <br />c. The County will apply SCORE funds previously available to the City for other eligible uses <br />directly to the yard waste program for the use of the sites by residents as described in 1.a. <br />d. The County will work with the City to cooperatively promote waste management programs. <br />2. CITY OBLIGATIONS <br />a. The City will forgo its annual allocation of Ramsey County SCORE funds in order to assure <br />services for those City residents that do not reside in the County. <br />b. Pursuant to the Ramsey County Solid Waste Management Master Plan, the City has a <br />number of obligations related to SCORE related activities, that it shall perform, as outlined <br />below: <br />i. The City is obligated to provide for recycling weekly or every other week to <br />people at their place of residence including but not limited to curbside, <br />multi -unit housing and manufactured home parks for the materials required <br />in the Ramsey County Solid Waste Master Plan. <br />
