CITY OF SAINT ANTHONY <br />ORDINANCE NO. 2012-03 <br />AN ORDINANCE IMPOSING A MORATORIUM ON THE ISSUANCE OF CONDITIONAL <br />USE PERMITS FOR ASSEMBLIES, MEETING LODGES, OR CONVENTION HALLS <br />WITHIN COMMERCIAL AND LIGHT INDUSTRIAL ZONING DISTRICTS <br />The City Council of the City of Saint Anthony Village ordains as follows: <br />Section 1. Recitals. Section 152.122(C) of the Zoning Code allows for the permitted <br />conditional use of "assembly, lodge, or convention halls" within the Commercial District. <br />Section 152.142(G) of the Zoning Code allows for the permitted conditional use of "assembly, <br />meeting lodge, or convention halls" within the Light Industrial District. Under Minnesota <br />Statutes section 462.355, subd. 4, if a city has authorized a study to be conducted for the propose <br />of considering amendments to its zoning code, the governing body of the city may adopt an <br />interim ordinance for the purpose of protecting the planning process and the health, safety and <br />welfare of its citizens. The interim ordinance may regulate, restrict or prohibit any use, <br />development or subdivision within the city or any portion thereof for a period not to exceed one <br />year from the date it is effective. <br />Section 2. Moratorium Imposed. For the purpose of protecting the planning process <br />while the City is conducting a study for the purpose of considering amendments to the Zoning <br />Code with respect to the regulation of assemblies, meeting lodges, and convention halls, a <br />moratorium is imposed on the issuance by the City of Conditional Use Permits Linder sections <br />152.122(C) and 152.142(G) of the City Code pursuant to the authority contained in Minnesota <br />Statutes section 462.355, subd. 4. This moratorium shall be in effect for a period of one year <br />from the effective date of this ordinance unless earlier terminated by the City Council. <br />Section 3. Effective Date.
