The City currently needs to request <br />debits to allow construction of its street and utility improvement projects. However, under the <br />current framework of RCWD Rules it is impossible for the City to offset these debits due to the <br />clay soils present throughout the City. <br />By establishing this agreement between the City and RCWD, the City will be able to comply <br />with RCWD Rules for the City's future street and utility improvement projects. Compliance will <br />be achieved by providing cost-effective, regional water quality improvements near the <br />reconstruction projects. <br />Enclosed is a draft version of the memorandum of agreement, which is subject to review and <br />approval by the Rice Creek Watershed District Staff and Board of Managers. <br />A presentation showing the basis for the agreement will be made at the May 22, 2012 Council <br />Meeting.
