75 <br />MEMORANDUM of AGREEMENT <br />City of St. Anthony and the Rice Creek Watershed District <br />This Memorandum of Agreement (MOA) is made by the City of St. Anthony, a statutory <br />city and governmental subdivision of the State of Minnesota, and the Rice Creek <br />Watershed District (RCWD), a special purpose governmental subdivision with powers <br />set forth in Minnesota Statutes chapters 103B and 103D (together, the parties). <br />Recitals <br />A. Pursuant to Minnesota Statutes §§103B.211, 103D.341 and 103D.345, the <br />RCWD has adopted and implements Rule C, Stormwater Management Plans, which <br />imposes water quality and runoff retention requirements on land -disturbing projects. <br />B St. Anthony intends to undertake a street reconstruction program over the years <br />2012 to 2024 (hereinafter, "SRP"). The SRP is described in Exhibit A, attached to and <br />incorporated into this Agreement. <br />C. To facilitate efficient public budgeting, planning and coordination, the parties <br />are entering into this MOA to establish a framework for St. Anthony to meet the <br />requirements of the RCWD's stormwater management rule for its SRP. This MOA <br />includes an advance determination of the eligible methods and locations for <br />stormwater management Best Management Practices (BMPs) and sets forth procedures <br />for the parties to cooperate on regulatory review related to street reconstruction during <br />the 2012-24 period. St. Anthony and the RCWD agree that this MOA is binding and <br />rests on good and valuable consideration. <br />Terms <br />1.
