City Council Regular Meeting Minutes <br />June 12, 2012 <br />Page 7 <br />Mr. Chris Kachman, 3043 Croft Drive, appeared before the City Council and expressed concern <br />that the City is making an exception to the zoning laws that changes the use of the building and <br />the impact on the residential area. <br />Mr. Abdi Muse, 2711 Grand Avenue South, Minneapolis, appeared before the City Council and <br />stated the City Council has the ability to make the City a welcoming place for everybody. He <br />asked the City Council to approve the request. <br />9 Mr. Thomas Shayn, 3209 Edward Street, appeared before the City Council and stated this <br />10 building will encounter significant ADA compliance issues. I -Ie stated the City will have to <br />11 enforce tighter use around food and the building will need a commercial kitchen. He indicated <br />12 this building was built as an office building and it will cost money to bring it up to Code and <br />13 meet ADA requirements and it may cost more than the building is worth. He felt this was not an <br />14 appropriate use and was hopeful the City would determine this is not an appropriate use within <br />15 current codes. He added this is not prejudice and he wants everyone to be treated equally, but <br />16 felt this building was not designed for the proposed use and should remain light commercial. <br />17 <br />18 Mr. John Kaczor, 3404 32°`1 Avenue NE, appeared before the City Council and expressed <br />19 concern about the traffic and noise. He stated he was also concerned about safety and possible <br />20 violence against the Islamic Center. <br />21 <br />22 Ms. Aysha Nazwaz, 1946 3`d Street NW, New Brighton, MN 55112, appeared before the City <br />23 Council and stated the more we know about people the more we tend to break down barriers. <br />24 She stated that stereotyped images can create a lot of tension and there is no way to have a multi - <br />25 cultural place live in peace unless you break down the barriers by giving people a chance to <br />26 speak and get to know one another. <br />27 <br />28 City Attorney Lindgren stated that Minnesota Statutes Section 15.99 requires the City Council to <br />29 take action this evening on the CUP application to either approve or deny the request. He <br />30 advised the City Council has the Planning Commission's recommendation and a resolution with <br />31 the Planning Commission's conditions and the City Council can accept or modify any of those <br />32 conditions. He stated the City Council can also consider denial of the CUP request based on the <br />33 record and if there is a motion for denial, the City Council would advise staff to prepare findings <br />34 for consideration consistent with the record and brought back at a subsequent meeting, however, <br />35 given the deadline, the City Council must consider those findings tonight. He presented draft <br />36 findings for the City Council that could lead the City Council to conclude to deny the CUP. Iie <br />37 then provided a written narrative of the record in this matter and this narrative is part of the <br />38 official record. He advised that consistent with the study findings and recommendation to <br />39 approve Option Three, the City Council asked staff to prepare a text amendment to eliminate all <br />40 assembly use from the Light Industrial district. He stated the City Council can also approve the <br />41 recommendation of the Planning Commission to approve the CUP request with detailed <br />42 conditions and any additional or amended findings remain the right and prerogative of the City <br />43 Council. <br />44 <br />45 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 12- <br />46 054, Denying a Conditional Use Permit for Religious Assembly at 3055 Old Highway 8. <br />
