34 <br />prohibiting their use in all public places and others treating the sale of e -cigarettes the <br />same as the sale of tobacco products. <br />g. The use and sale of e -cigarettes are recent developments, and further study and <br />consideration of potential effects that they might have on the public's health, safety, <br />order, convenience and general welfare is required to ensure that any negative <br />impacts can be addressed and mitigated. <br />It. Under Minnesota Statutes section 462.355, subd. 4, if a city has authorized a study to <br />be conducted for the purpose of considering amendments to its official controls, the <br />governing body of the city may adopt an interim ordinance for the purpose of <br />protecting the planning process and the health, safety and welfare of its citizens. The <br />interim ordinance may regulate, restrict or prohibit any use, development or <br />subdivision within the city or any portion thereof for a period not to exceed one year <br />from the date it is effective. <br />Section 2. Moratorium Imposed. For the purpose of protecting the planning process <br />while the City is conducting a study for the purpose of considering amendments to the City's <br />official controls, including the Zoning Code, with respect to the regulation of e -cigarettes and <br />similar devices, a moratorium is imposed on the creation, establishment or operation of any <br />business in the City that sells e -cigarettes or the liquid products used in them other than those <br />businesses that have current valid tobacco licenses as of the effective date of this Interim <br />Ordinance. Further, a moratorium is hereby imposed on any business currently licensed to sell <br />tobacco that also sells e -cigarettes from allowing on-site sampling of e -cigarettes and related <br />products. This moratorium shall remain in effect for a period of one year after the effective date <br />of this Interim Ordinance unless earlier terminated by the City Council. The term of this Interim <br />Ordinance and the moratorium issued hereby may be extended for a reasonable period of time by <br />Ordinance as may be necessary to complete the City's authorized study and to adopt any <br />necessary modifications to the City's official controls. <br />Section 3. Severability. Every section, provision, or part of this Interim Ordinance is <br />declared severable from every other section, provision, or part, and if any portion of this Interim <br />Ordinance is held invalid or unenforceable by a Court of competent jurisdiction, it shall not <br />invalidate any other section, provision or part of this Interim Ordinance. <br />Section 4. Effective Date.
