40 A. REQUEST — Request from Silver Lake 1996 LLC on behalf of Inland Silver Lake
41 Village, LLC, a Delaware Limited Liability Company, for a Conditional Use Permit to
42 allow a drive-through window on the south side of the existing Cub Foods Store to
43 serve the in-house pharmacy on the property located at 3930 Silver Lake Road.

45 City Planner Johnson presented the request for a CUP for a drive-through window associated
46 with the in-house pharmacy at Cub Foods and presented a diagram of the existing conditions
47 on the site and stated there is currently parking on the south side of the building where the
48 proposed drive-through will be located. She also presented an elevation drawing of the
49 proposed drive-through window and stated that the canopy is 10' above the drive-through to

1 allow for larger vehicles. She advised the applicant has proposed signage to advertise the
2 drive-through along the south and east walls as well as three or four flat lenses light fixtures
3 under the overhang, adding that these light fixtures meet the City's requirements. She stated
4 the hours of operation for the drive-through will be 9:00 a.m. to 9:00 p.m., however, because
5 this Cub Foods has a lot of pharmacy volume, the hours are subject to change and could be
6 changed to 8:00 a.m. to 10:00 p.m. She pointed out that the hours of operation are not
7 dictated by City Code but given the large separation between the drive-through and the
8 adjacent high density residential garages, staff does not perceive that the hours of operation
9 will be a nuisance. She stated if it becomes a nuisance, the City could control this through
10 Code enforcement via the noise ordinance. She reviewed the parking on site and explained
11 that a number of parking spaces will be eliminated on the south side to accommodate the
12 drive-through window. She pointed out that sidewalk connections along the east side of the
13 front of the building are not shown on the proposed plan these sidewalk conditions are
14 included as a condition of approval. She advised that the applicant has proposed the addition
15 of four trees as well as a number of shrubs on the drive aisle and islands within the parking lot
16 to maintain and enhance the existing visual character in the development. She stated that the
17 proposed use is one of the conditional uses specifically listed in the PUD, the grocery store is
18 allowed to have a drive-through facility, and the proposed use will not be detrimental to the
19 health, safety, or general welfare of persons residing or working in the vicinity. She advised
20 that the City Engineer reviewed the proposed use from a circulation and traffic standpoint and
21 was comfortable with the proposed use with the exception of the inclusion of the sidewalk and
22 markings and the proposed use will provide a service or facility which is in the best interest of
23 the public and will be an amenity to the City once implemented.

25 Commissioner Papatola requested fiuther detail about what City staff did to ascertain that
26 traffic would be manageable, adding that he was concerned about pedestrian and bike traffic
27 in the area. He also asked about the anticipated usage of the drive-through window.

29 City Planner Johnson explained that the City Engineer reviewed traffic movements into and
30 out of the driving lane and noted that the existence of markings at the east side of the drive -
31 through aisle as well as the addition of a stop sign will require traffic to adhere to automobile,
32 pedestrian, and bike traffic and the City Engineer was comfortable with those movements.
33 She added that staff s transportation analysis included a review of the numbers for stacking
34 distance in terms of the number of vehicles and the City Engineer was comfortable with a
35 four -vehicle stacking distance.

37 Ms. Ann Thies approached the City Council on behalf of the applicant and introduced Mr.
38 Jason Reames and Mr. Doug McQuay. She stated that the volume of traffic at the drive -
39 through pharmacies at their stores has been fairly consistent throughout the day, adding that
40 they have never had more cars lined up in the queue than what is planned at this location. She
41 agreed to provide more specific information if requested by the Planning Commission.

43 Commissioner Bartel asked if there was any concern about a fifth or sixth car in the queue
44 blocking traffic if it turns out that the volume is heavier than anticipated.

Mr. Jason Reames, Pharmacy District Manager, stated their busiest pharmacy does a 25%
higher volume than the cun•ent volume at this store and he felt that the stacking distance was
sufficient. He added that even if the volume increased, he did not believe that cars would
stack up to five or six vehicles because they currently have pharmacies that are busier than
this location and they have not experienced this amount of stacking at other pharmacies.
City Planner Johnson stated that a comparison of the stacking distance in other communities
with drive-through windows revealed that Cub Foods's practice has been to direct people to
come back later if it appears there is excessive stacking of vehicles. She noted there are 563
parking spaces that drivers could use and if excessive stacking becomes an issue, staff can
work with the applicant to manage that through code enforcement.
Commissioner Papatola expressed concern about eliminating parking spaces on the south side
because of the other businesses to the north including the municipal liquor store and stated he
did not want to place those businesses at a competitive disadvantage.
City Planner Johnson stated that Cub Foods is a separate parcel from the PUD and they are
required by Ordinance to have 563 spaces and with the addition of the drive-through window,
there are still 563 parking spaces. She advised that that owner of the property is not overly
concerned about parking and intends to distribute a mailer to the businesses indicating that
some parking needs to be reallocated to another space. She added that staff spoke with Mr.
Larson at the municipal liquor store about their employees using this area and Mr. Larson
indicated that he understood the employees would have to park further to the east.
Chairperson Crone asked about the distance between the drive-through window and the
sidewalk. She also asked about noise volumes from the drive-through window.
City Planner Johnson replied that a typical car is 18-20' and there is approximately 40-60' to
the sidewalk.
Mr. McQuay stated that the speaker system at the drive-through is low volume and is located
only two feet away from the vehicles at the drive-through window.
Commissioner Heinis expressed concern about having the drive-through located right at the
comer of the building near a busy sidewalk and the possibility of endangering pedestrians.
Mr. McQuay indicated the addition of the stop sign would enhance safety in this area, adding
that the sidewalk is approximately 20' from the curb to the building so there will be good
visibility in the area.
Chairperson Crone opened the public hearing at 7:27 p.m. No speakers were present.

Commissioner Poucher expressed concern about the proximity of the apartment buildings and
the possibility of vehicle headlights becoming a nuisance.

1 City Planner Johnson stated the drive-through aisle is located directly across the pond where
2 the parking garages are located and staff does not anticipate a problem with headlights. She
3 added there is a lot of distance between the drive-through and the parking garages and the
4 City's glare ordinance would not apply in this case because of the distance and the lumens
5 from the headlights would be diluted.

7 Commissioner Papatola stated he did not wish to hold up the vote on this matter, but had some
8 remaining concerns about the proposed CUP and would like to have more data, including
9 hearing from traffic management and from the municipal liquor store.

11 Commissioner Niccum felt staff had done a good job of addressing all concerns and in
12 speaking with the businesses affected by the CUP.

14 Motion by Commissioner Niccum, second by Commissioner Heinis, to recommend that the
15 City Council approve a Conditional Use Permit (CUP) to allow a drive-through window on
16 the south side of the existing Cub Foods Store to serve the in-house pharmacy on the property
17 located at 3930 Silver Lake Road.

Notice is hereby given that on June 23, 2014, 7:00 p.m. at City Hall, 3301 Silver Lake Road, the Saint
Anthony Village Planning Commission will hold a public hearing to solicit public response to a request

CONSIDERATIONS RELATING TO THE PROPOSED ZONING ORDINANCE TEXT AMENDMENT
1. Background
The Applicant wishes to install a double sided electronic sign in front of the St. Charles Borromeo
Catholic School located at 2739 Stinson Boulevard (2420 St. Anthony Boulevard per Hennepin
County Recorder's Office) as shown in Exhibit B: Applicant's Application.
Chapter 1S5.22.B.20: Prohibited Signs of the Zoning Ordinance states that the following signs are
prohibited: "Electronic message signs. Electronic message or changeable copy signs except public
service signs in the Recreational Open Space District located on property that is owned by the city or
Independent School District No. 282."
Requests to modify this language in the Zoning Ordinance to allow electronic message signs have
been received and heard in the past, but have historically been denied by the City Council.

2. Applicable Codes.
Title XV Land Usage, Chapter 155 Sign Code, Section §155.02 discusses the findings, purpose and
intent, and effects of the Sign Code.
The City Council in enacting a Sign Code found that:
1. Exterior signs have a substantial impact on the character and quality of the environment;
2. Signs provide an important medium through which individuals may convey a variety of
messages;
3. Signs can create traffic hazards, aesthetic concerns and detriments to property values, thereby
threatening the public health, safety and welfare;
4. The city's code of ordinances have, since as early as 1983, established standards which would
permit businesses in the city a reasonable and equitable opportunity to identify themselves.
The regulation of signs is an effort to provide adequate means of expression and to promote
the economic viability of the business community;
5. To preserve and promote civic beauty and protect the city and its citizens from a proliferation
of signs of a type, size, location and character that would adversely impact upon the
aesthetics of the community and threaten the health, safety and welfare of the community;
and
6. To preserve and protect the value of land and buildings, and to preserve and protect
landscapes.
The purpose and intent is not to regulate the message displayed on any sign; nor to regulate any
building design or any display not defined as a sign, or any sign which cannot be viewed from
outside a building. The purpose is to:
1. Regulate the number, location, size, type, illumination and other physical characteristics of
signs within the city in order to promote the public health, safety and welfare;
2. Maintain, enhance and improve the aesthetic environment of the city by preventing visual
clutter that is harmful to the appearance of the community;
3. Improve the visual appearance of the city while providing for effective means of
communication, consistent with constitutional guarantees and the city's goals of public safety
and aesthetics;
4. Provide for fair and consistent enforcement of the sign regulations set for herein under the
zoning authority of the city.
As a result, the effect of the city's Sign Code, was to allow signs to be erected, mounted, displayed or
maintained in the city if it is in conformance with the provisions of the Sign Code regulations. More
specifically, is to:
1. Allow a wide variety of sign types in commercial zones, and more limited variety of signs in
other zoning districts subject to the standards set forth in this sign ordinance;
2. Allow certain small, unobtrusive signs incidental to the principal use of a site in all zoning
districts when in compliance with the requirements of this sign ordinance;
3. Prohibit signs whose location, size, type, illumination or other physical characteristics
negatively affect the environment and where the communication can be accomplished by
means having a lesser impact on the environment and the public health, safety and welfare;
and
4. Provide for the enforcement of the provisions of this sign ordinance.

Title XV Land Usage, Chapter 155 Sign Code, Section §155.03 defines an "Electronic Message Sign"
as "any sign that displays a message electronically through the use of pixel -based technology, such
as but not limited to light emitting diodes (LEDs), liquid crystal, etc.
CONCLUSIONS
Electronic message signs are permitted in the ROS — Recreation Open Space Zoning District on property
that is owned by the city or Independent School District No. 282. Currently there are three (3) electronic
message signs located within the City, including one at City Hall, one at Wilshire Park Elementary School,
and one at St. Anthony High School.
Historically the City of St. Anthony Village has not approved text amendments to allow electronic
message signs on property that are outside of the ROS — Recreation/Open Space Zoning District. In the
past, the Planning Commission and City Council have reviewed requests for a text amendment, which
included an analysis of the change in message (scrolling, flashing, blinking, animations, etc.), colors
allowed (monochromatic vs. array of colors), automatic shutoff and dimming features, size limitations,
message timing, placement and spacing between multiple electronic signs, etc.
The Applicant has expressed a desire to have an electronic message sign in front of their school only (as
opposed to in front of the school and the church buildings) on site. They have expressed a need to relay
information to the public as it relates to school activities and other ongoing announcements.
The Planning Commission may consider whether an amendment to Chapter 155: Sign Code is desired to
allow electronic message signs in the R1 District or not.
POTENTIAL ACTIONS
1. Request Additional Information and Continue the Public Hearing. Should the Planning
Commission request additional information from the Applicant, the Planning Commission should
continue the public hearing until a later time.
2. Recommend Approval of the Proposed Zoning Ordinance Text Amendment. In the event of a
recommendation for approval (with or without modifications), the Planning Commission may
refer to Exhibit C and may modify the draft ordinance for approval to include any amendments
that it deems necessary.
3. Recommend Denial of the Proposed Zoning Ordinance Text Amendment. In the event the
Planning Commission chooses denial of the requested zoning ordinance text amendment, it
should clearly state its reasons for the denial recommendation and direct staff to prepare a
resolution of denial for consideration at the City Council meeting.

Filing and Information Requirements
The City requests that you make a pre -application meeting with the City Planner to discuss the application process,
requirements, and deadlines. Unless waived by the City Planner or Planning Commission, a certified survey of the
property is required for all applications. A checklist with additional requirements can be found at www.ci.saint-
anthonv.mn.us.
Incomplete Applications and Submission Deadline
A complete land use application (including all required fees and escrows) must be received at least 30 days prior to the
meeting of the Planning Commission or City Council meeting at which the request will be heard. Submission of an
incomplete application may delay the processing of your land use request. The application approval time commences
and an application is considered officially filed when the City Planner has received and examined the application and
determined that the application is complete. A decision on whether the application is complete or incomplete shall be
made within fifteen (15) working days following the submittal of the application. When the application is deemed to be
"complete" it shall be placed on the agenda of the first possible Planning Commission meeting provided that all required
public notices have been sent and published. Upon submission of a complete application, state statute requires that a
decision be issued within 60 days regarding each request; however, a 60 -day extension may be obtained if more time is
needed.
Notice of Meeting Attendance
In order for the Planning Commission and the City Council to consider any application, the applicant or a designated
representative must be present at the scheduled meeting. If not, the matter may be tabled until the next available
agenda.

Planning Commission meetings are typically held on the fourth Monday of every month at 7:00 p.m., while City Council

public health, safety, and, welfare, and is compatible with the City's Comprehensive
Plan.
Section Three. Effective Date. This Ordinance shall be in full force and effect

CONSIDERATIONS RELATING TO THE PROPOSED ZONING ORDINANCE TEXT AMENDMENT
1. Background
The Applicant wishes to install a stationary electronic sign for the display of gas prices at the St.
Anthony Mobil store located at 2801 Kenzie Terrace as shown in Exhibit B: Applicant's Application,
Chapter 155.22.B.20: Prohibited Signs of the Zoning Ordinance states that the following signs are
prohibited: "Electronic message signs. Electronic message or changeable copy signs except public
service signs in the Recreational Open Space District located on property that is owned by the city or
Independent School District No. 282."
Requests to modify this language in the Zoning Ordinance to allow electronic message signs have
been received and heard in the past, but have historically been denied by the City Council.
Specifically, in 2006, the Applicant's presented the same request before the City Council which was
denied.

2. Applicable Codes.
Title XV Land Usage, Chapter 155 Sign Code, Section §155.02 discusses the findings, purpose and
intent, and effects of the Sign Code.
The City Council in enacting a Sign Code found that:
1. Exterior signs have a substantial impact on the character and quality of the environment;
2. Signs provide an important medium through which individuals may convey a variety of
messages;
3. Signs can create traffic hazards, aesthetic concerns and detriments to property values, thereby
threatening the public health, safety and welfare;
4. The city's code of ordinances have, since as early as 1983, established standards which would
permit businesses in the city a reasonable and equitable opportunity to identify themselves.
The regulation of signs is an effort to provide adequate means of expression and to promote
the economic viability of the business community;
5. To preserve and promote civic beauty and protect the city and its citizens from a proliferation
of signs of a type, size, location and character that would adversely impact upon the
aesthetics of the community and threaten the health, safety and welfare of the community;
and
6. To preserve and protect the value of land and buildings, and to preserve and protect
landscapes.
The purpose and intent is not to regulate the message displayed on any sign; nor to regulate any
building design or any display not defined as a sign, or any sign which cannot be viewed from
outside a building. The purpose is to:
1. Regulate the number, location, size, type, illumination and other physical characteristics of
signs within the city in order to promote the public health, safety and welfare;
2. Maintain, enhance and improve the aesthetic environment of the city by preventing visual
clutter that is harmful to the appearance of the community;
3. Improve the visual appearance of the city while providing for effective means of
communication, consistent with constitutional guarantees and the city's goals of public safety
and aesthetics;
4. Provide for fair and consistent enforcement of the sign regulations set for herein under the
zoning authority of the city.
As a result, the effect of the city's Sign Code, was to allow signs to be erected, mounted, displayed or
maintained in the city if it is in conformance with the provisions of the Sign Code regulations. More
specifically, is to:
1. Allow a wide variety of sign types in commercial zones, and more limited variety of signs in
other zoning districts subject to the standards set forth in this sign ordinance;
2. Allow certain small, unobtrusive signs incidental to the principal use of a site in all zoning
districts when in compliance with the requirements of this sign ordinance;
3. Prohibit signs whose location, size, type, illumination or other physical characteristics
negatively affect the environment and where the communication can be accomplished by
means having a lesser impact on the environment and the public health, safety and welfare;
and
4. Provide for the enforcement of the provisions of this sign ordinance.

Title XV Land Usage, Chapter 155 Sign Code, Section §155.03 defines an "Electronic Message Sign"
as "any sign that displays a message electronically through the use of pixel -based technology, such
as but not limited to light emitting diodes (LEDs), liquid crystal, etc.
CONCLUSIONS
Electronic message signs are permitted in the ROS — Recreation Open Space Zoning District on property
that is owned by the city or Independent School District No. 282. Currently there are three (3) electronic
message signs located within the City, including one at City Hall, one at Wilshire Park Elementary School,
and one at St. Anthony High School.
Historically the City of St. Anthony Village has not approved text amendments to allow electronic
message signs on property that are outside of the ROS — Recreation/Open Space Zoning District. In the
past, the Planning Commission and City Council have reviewed requests for a text amendment, which
included an analysis of the change in message (scrolling, flashing, blinking, animations, etc.), colors
allowed (monochromatic vs. array of colors), automatic shutoff and dimming features, size limitations,
message timing, placement and spacing between multiple electronic signs, etc.
The Planning Commission may consider whether an amendment to Chapter 155: Sign Code is desired to
allow electronic message signs in the C District or not.
POTENTIAL ACTIONS
1. Request Additional Information and Continue the Public Hearing. Should the Planning
Commission request additional information from the Applicant, the Planning Commission should
continue the public hearing until a later time.
2. Recommend Approval of the Proposed Zoning Ordinance Text Amendment. In the event of a
recommendation for approval (with or without modifications), the Planning Commission may
refer to Exhibit C and may modify the draft ordinance for approval to include any amendments
that it deems necessary.
3. Recommend Denial of the Proposed Zoning Ordinance Text Amendment. In the event the
Planning Commission chooses denial of the requested zoning ordinance text amendment, it
should clearly state its reasons for the denial recommendation and direct staff to prepare a
resolution of denial for consideration at the City Council meeting.

Description of the Request (OR a separate detailed narrative explaining the project):
We, the owner & management of St. Anthony Mobil Inc, are requesting an amendment and/or change
to subsection 155.22 line 20 of the City Code Land Use Section. Currently the code prohibits electronic
message signs, except those used by the city or ISD 282. We propose an amendment or change
to the code to allow gasoline stations to use electronic message signs to display gas prices, and gas prices only.
Our previous request was denied as the council and mayor claimed the electronic sign would be hazardous to drivers on the road.
The code has changed since our last request, and now allows the city and ISD 282 the use of such signs. Manual, changeable copy signs
have become out -dated, even hazardous, to use at gas stations as prices can change multiple times in a week.
Our request is for stationary, gas price numbers that would not flash, or change at a constant pace,
unlike the signs on city property or property occupied by ISD 282 which change at constant pace.
Filing and Information Requirements
The City requests that you make a pre -application meeting with the City Planner to discuss the application process,
requirements, and deadlines. Unless waived by the City Planner or Planning Commission, a certified survey of the
property is required for all applications. A checklist with additional requirements can be found at www.ci.saint-
anthonv.mn.us.
Incomplete Applications and Submission Deadline
A complete land use application (including all required fees and escrows) must be received at least 30 days prior to the
meeting of the Planning Commission or City Council meeting at which the request will be heard. Submission of an
incomplete application may delay the processing of your land use request. The application approval time commences
and an application is considered officially filed when the City Planner has received and examined the application and
determined that the application is complete. A decision on whether the application is complete or incomplete shall be
made within fifteen (15) working days following the submittal of the application. When the application is deemed to be
"complete" it shall be placed on the agenda of the first possible Planning Commission meeting provided that all required
public notices have been sent and published. Upon submission of a complete application, state statute requires that a
decision be issued within 60 days regarding each request; however, a 60 -day extension may be obtained if more time is
needed.
